An Act to amend the Medical and Dental Practices Act 1976.

BE IT ENACTED by the Parliament of the Cook Islands in session assembled, and by the authority of the same, as follows:

1. Short Title - This Act may be cited as the Medical and Dental Practices Amendment Act 1981 and shall be read together with and deemed part of the Medical and Dental Practices Act 1976 (hereinafter referred to as the "principal Act".

2. Amendment of register of person wrongfully registered or where particulars incorrect - The principal Act is hereby amended by inserting after section 20 the following new section:

"20A. (1) Amendment of register of person wrongfully registered or where particulars incorrect - If at any time the Council has cause to believe that any person has been registered as a Medical or Dental Practitioner or conditionally registered as such by reason of any false or fraudulent representation or declaration, made either orally or in writing, or if any person not entitled to be registered as aforesaid has been registered, the Council shall cause the new of that person to be removed from the register, and the fact of that removal shall be notified by the Secretary of the Council in the Cook Islands Gazette.

(2) For the purposes of this section of this Act the burden of proving the truth of the representation, declaration or particulars in respect of qualification that would, if true, entitle the person to registration or conditional registration, shall at all times be upon the person claiming to be entitled to such registration."
