An Act to amend the Prisons Act 1967
(17 February 1999
BE IT ENACTED by the Parliament of the Cook Islands in Session assembled, and by the authority of the same as follows:
This Act may be cited as the Prisons Amendment Act 1999 and shall be read together with and deemed part of the Prisons Act 1967 (hereinafter referred to as "the principal Act").
Subsection (3) of section 5 of the principal Act is amended by inserting immediately after the word "prison" and before the word "there" the words "wherever possible".
Subsection (1) of section 8 of the principal Act is amended by deleting the words "Commissioner of the High Court" and substituting the words "Justice of the Peace of the Cook Islands".
Section 17 of the principal Act is amended by -
(a) deleting from subsection (3), the words "with the concurrence of the Minister of Finance"; and
(b) repealing subsection (4).
Subsection (3) of section 27 of the principal Act is amended by repealing paragraph (d).
Section 34 of the principal Act is amended by inserting immediately after the word "Coroner", the words ", the Secretary of Justice and the Commissioner of Police".
Subsection (3) of section 28 of the principal Act is amended by repealing paragraph (d).
Section 36 of the principal Act is amended by -
(a) deleting from subsection (1), after the words "fine not exceeding" the word "one", and substituting the word "two"; and
(b) deleting from subsection (3), after the words "fine not exceeding" the word "one", and substituting the word "two".
Section 37 of the principal Act is amended by –
(a) deleting from paragraph (c) of subsection (2), the word "diet";
(b) deleting from subsection (4), after the words "fine not exceeding" the word "one" and substituting the word "two"; and
(c) repealing subsection (5).
