An Act to amend the Shipping Registry Act 1985

BE IT ENACTED by the Parliament of the Cook Islands in Session assembled, and by the authority of the same as follows:
This Act may be cited as the Shipping Registry Amendment Act 1994 and shall be read together with and deemed part of the Shipping Registry Act 1985 (hereinafter referred to as "the principal Act").
Section 2 of the principal Act is amended by adding, after paragraph (b) in the definition of "ship", the following new paragraph -
"(c)" Fishing vessels."
The principal Act is amended by inserting after section 12, the following new section –
"12A. Exemptions
(1) The Minister, acting on the advice of the Registrar, may exempt any ship from the requirements of section 12(b) if he is satisfied -
- (a) that the safety requirements appropriate to that ship have been met; and
- (b) that steps are being taken to bring the ship into class with one of the Classification Societies listed in the First Schedule.
(2) Every exemption - granted under this section shall be for such period as the Minister may determine, not exceeding 12 months, but such period may be renewed by the Minister.
(3) The owner of a ship in respect of which an exemption is sought pursuant to this section shall upon making application for the exemption furnish a surveyor's report on that ship to the Registrar."
