DISTILLATION (PROHIBITION) REGULATION 1909

KING'S REGULATION

TO PROHIBIT THE DISTILLATION OF SPIRITS IN THE PROTECTORATES OF THE BRITISH SOLOMON ISLANDS AND THE GILBERT AND ELLICE ISLANDS.

Made by His Britannic Majesty's Acting High Commissioner for the Western Pacific under the authority of His Majesty's Commission.

In the name of His Majesty, Edward the Seventh, of the United Kingdom of Great Britain and Ireland and of the British Dominions beyond the Seas King, Defender of the Faith, Emperor of India.

Short title.
1. This Regulation may be cited as the Distillation (Prohibition) Regulation, 1909.

Interpretation of "Protectorates."
2. In this Regulation -

"Protectorates" means the Protectorates of the Solomon Islands and the Gilbert and Ellice Islands.

Offences.
3. Any person -

(a) who shall import into or set up in, the Protectorates any still, or any machinery, implements or utensils used for the distillation of spirits; or

(b) who shall have in his possession or custody, or upon whose premises shall be found, any still, still-head, worm, or outer machinery, implement or utensil used in connection with the distillation of spirits, whether imported into the Protectorates before the coming into operation of this Regulation or not; or

(c) who shall make, or aid or assist or be otherwise concerned in making any spirits; or

(d) who shall supply any materials for making or working any still; or

(e) who shall convey or conceal, or aid or assist in conveying and concealing, or upon whose premises shall be found, any spirits distilled or made in the Protectorates;
Penalty.
shall be liable to a fine not exceeding fifty pounds and in default of payment to a term of imprisonment not exceeding six months.

Seizure of forbidden articles.
4.-(1) It shall be lawful for any police officer, or any person authorised in writing by the Resident Commissioner, of the Protectorate where there are any premises used as a distillery, or whereon there is reason to believe there are any machinery, materials, implements or utensils used in the process of distillation of spirits, or any spirits made or distilled in that Protectorate, to enter upon those premises and seize the articles herein set forth or any of them.

(2) The officer or person aforesaid may break open doors and use such other force as may be necessary to effect the entry and make the seizure by this section authorised.

Penalty for obstruction.
(3) Any person who shall obstruct or resist any police officer, or other person aforesaid, in the exercise of any power to him given by this section, or who shall offer him any bribe, or endeavour in any way to induce him, to abstain from so exercising his power, shall be liable to a penalty not exceeding fifty pounds and in default of payment to a terms of imprisonment not exceeding six months.

Forfeiture.
5. Any still, still-head, worn, or other machinery, implements, or utensils, imported into or used in the Protectorates, and all spirits distilled or made therein contrary to the provisions of this Regulation shall be forfeited and shall be destroyed by the Resident Commissioner of the Protectorate wherein the forfeiture has been incurred or by an officer or a person authorised by him to do so.
