AN ACT TO AMEND THE INDUSTRIAL RELATIONS CODE

Made by the Maneaba ni Maungatabu and assented to by the Beretitenti.


1. Short title


This Act may be cited as the Industrial Relations Code (Amendment) Act 2013.


2. Interpretation


The Principal Act means the Industrial Relations Code.


3. Amendment of section 14


Section 14 of the Principal Act is amended by inserting a new subsection at the end of the subsection (4), which shall read as follows:


"(5) Any employer or employee who fails to comply with the award of the tribunal commits an offence and shall upon conviction be liable to a fine not exceeding $5,000 or six months imprisonment or both."

Explanatory Memorandum


The intention of this Act is to create an offence if the employer fails to comply with the award of the tribunal so as to ensure that the employer complies with the award otherwise he will be liable for a criminal offence and can be fined a sum not exceeding $5,000 or six months imprisonment or both if found guilty.
