AN ACT TO AMEND THE SALARIES AND ALLOWANCES OR MEMBERS OIL THE MANEABA NI MAUNGATABU AND SALARIES TRIBUNAL (Revised Edition 1996 as amended by No 12 of 1997).
Commencement:
2001
1. Short title
This Act may be cited as the Salaries and Allowances of Members of the Maneaba ni Maungatabu and Salaries, Tribunal (Amendment} Act 2001.
2. Commencement
This Act shall come into operation as follows -
(a) Section 3 shall be deemed to have come into -operation on r1 January 2001; and
(b) All the other sections shall come into operation on 1 January 2002.
3. Amendment of Schedule
Tine Schedule (herein referred to as "the Schedule") to the Salaries and Allowances of Members of the Maneaba ni Maungatabu and Salaries Tribunal Act (Revised Edition 1996 as amended by No 12 of 1997) (hereinafter referred -to as "the principal Act") is - amended as follows -
(a) by repealing "15800" appearing in Column 2 of the Schedule headed Salary opposite to item Beretitenti (which relates to Beretitenti) and substituting "16500"; and -
(b) by repealing "15000" appearing in Column 2 of the Schedule headed Salary opposite to item Kauoman ni Beretitenti (which relates to Kauoman ni Beretitenti) and substituting"15700"; and .
(c) by repealing "14200" appearing in Column 2 of the Schedule headed Salary opposite to item Minister (which relates to Minister) and substituting "14900"; and .
(d) by repealing "1120" appearing in Column 2 of the Schedule opposite to item Elected Members (which relates to the elected member) and substituting "11900".
(e) by repealing -
(i) "30" appearing in Column 4 of the Schedule headed Sitting Allowance opposite to item Chairman of Maneaba Members Salaries Tribunal (which relates to Chairman) and substituting "50"; and
(ii) "25" appealing in Column 4 of the Schedule heading Sitting Allowance opposite to item Member of Maneaba Members Salaries Tribunal (which relates to member) and substituting "45".
4. Amendment of section 4
Section 4 of the principal Act is amended as follows: -
(a) (i) in subsection (l)(a)(iv) by repealing "on the same basis as a public officer" where they
appear and substituting " in a sum equal to the amount payable to the Beretitenti"; and
(ii) in subsection (1)(b)(iv) by repealing "on the same basis as a public officer" where they appear and substituting "in a sum equal to half the amount payable to the Beretitenti; and
(iii) in subsection (1)(c)(iv) by repealing "or) the same basis as a public office" where they appear and substituting "in a sum equal to half the amount payable to the member"; and
(b) in subsection (7)(a) by repealing "$10" where it appears and substituting "$15".
5. Amendment of section 6
Section 6 of the principal Act is amended -
(a) in subsection (3) as follows -
(i) in paragraph (a)(i) by repealing "$40" where it appears and substituting
"$45"; and
(ii) in paragraph (a)(ill) by repealing "$15" where it appears and substituting "$20"; and
(iii) in paragraph (a)(iv) by repealing "$20" where it appears and substituting "$30";and
(iv) in paragraph (b)(i) by repealing "$40" where it appears and substituting "$45"and
(v) in paragraph (b) (iii) by repealing "$15" where it appears and
(b) in subsection (4) as follows -
(i) in paragraph (a) repealing "$10" where it appears and substituting "$15"; and
(ii) in paragraph (b) repealing "$10" where it appears and substituting "15".

EXPLANATORY MEMORANDUM
l. This Act seeks to amend the Salaries and Allowances of Members of the Maneaba ni Maumgatabu and Salaries Tribunal with a view to incorporating some of the recommendations of the Salaries Tribunal as contained in its Report dated July-October 2001 and also the Cabinet's own proposals itself
2. It will be noted therefore that there is a uniform increase of $700 made across the board to the salaries of all the members of the Maneaba including the Beretitenti and Ministers.
3. There is also an increase made to the subsistence allowance of Ministers when visiting their constituencies an official business from $10 to $15. Further the phrase "on the same basis as a public officer" is to be deleted and replaced with "in a sum equal to the amount payable to either the Beretitenti or the Minister or the Member as the case maybe. This relates to the amount of subsistence allowance which should be payable to an accompanying spouse and which amount should be half of the rate received by the principal spouse instead of basing it on the allowance of a public officer which is not always clear and easy to identify (See Section 4).
4. Other changes are contained in Section 4 and they are as follows -
(a) An increase to the subsistence allowance of all members when they are
accommodated in a rest house or hotel other than Kiritimati on official business from 540 to $45.
(b) An increase in the subsistence allowance of all the members when they are not accommodated in a rest house or hotel and are not on Kiritirimati on official business from $15 to $20.
(c) An increase in the subsistence allowance of all the members when they are not accommodated in a rest house or a hotel arid are on Kiritimati island on official business from $20 to $30.
(d) An increase in the meal allowance of members from Betio and Tarawa Teinainana including Ministers (if any) when attending sittings of the Maneaba ni Maungatabu from $10 to $15.
5. It is to be noted also that the sitting allowances of the Chairman and other members of the Maneaba Members Salaries Tribunal is also proposed to be increased from $30 to $50 for the chairman and froze $25 to $45 for other members. (see Clause 3)
