§801. Short title.
This Chapter may be cited as the Prohibition of Smoking (in Public Premises and Public Vehicles) Act, 1986. [P.L. 1986-19, §1.]
§802. Interpretation.
In this Chapter:
(a) "public premises" means any enclosed building and includes any government building or office, school, or hospital, or private premises where people have access thereto or assembled therewith, through common usage or by general invitation, express or otherwise, including restaurants, but does not include bars where liquor is served;
- (b) "public vehicle" means a bus or other vehicle, irrespective of whether privately owned or controlled, where people have access and are transported for a fee or fare or otherwise;
(c) "aircraft" means an aircraft used for air transport. [P.L. 1986-19,§2.][subsection (a) amended by P.L. 2003-98]
§803. Prohibition.
(1) Smoking in public premises, public vehicles, restaurants and aircrafts is hereby prohibited (2) In all public premises and public vehicles, there shall be conspicuously displayed a sign, "SMOKING IS PROHIBITED", by the owner, manager or the occupier of such premises or vehicle. §804. Restaurant Bars.
In the case of restaurants that offer liquor in a bar that is set up or constructed within, adjacent to or adjoining the dining area, the owner or manager of the premises shall designate by very conspicuous means, the division between the bar area and the dining area.. The prohibition contained in section 803 above shall apply to the dining area. [new section added by P.L. 2003-98]
§805. Penalty.
Any person who contravenes the provisions of Section 803 of this Chapter shall be guilty of an offense and shall upon conviction be liable to a fine not exceeding $2,500. [P.L. 1986-19, §4.][formerly section 804 but re-numbered by P.L. 2003-98]
