JUDICIARY (DISTRICT COURT TERM AMENDMENT) ACT 2015

An Act

To amend Subsection 227(2) of the Judiciary Act 1983, 27 MIRC Ch. 2, to provide that judges of the District Court shall hold office for a term of 10 years or until reaching the age 72 years, whichever first occurs.

BE IT ENACTED BY THE NITIJELA OF THE REPUBLIC OF THE MARSHALL ISLANDS:

Section 1 Short Title.

This Act may be cited as the Judiciary (District Court Term Amendment) Act, 2015.

Section 2 Amendment.

(1) Subsection 227(2) of the Judiciary Act, is amended to read as follows:

(2) A judge of the District Court shall be appointed by the Judicial Service Commission, shall serve for a term of ten (10) years, or until reaching the age of 72 years, whichever first occurs, and may be removed from office by it on the ground of clear failure or inability faithfully to discharge the duties of the office, for the commission of treason, bribery, or other high crime or abuse inconsistent with the authority of office.

Section 3 Effective Date.

This Act shall take effect on the date of certification in accordance with Article IV, Section 21 of the Constitution and Rules of Procedure of the Nitijela.
