Enacted by the Parliament of Nauru as follows:
- Short title
This Act may be cited as the Criminal Code 1899.
- Commencement
This Act commences upon certification by the Speaker.
- Amendment of Criminal Code
The Criminal Code 1899 is amended by the provisions of this Act.
- Insert new section 199A
- 199A Obstructing medical personnel
- (1) A person commits an offence and is liable to 2 years imprisonment if they wilfully obstruct any medical personnel who is responding
to a medical issue or attempting to administer medical treatment to another person.
- (2) It is not a defence to subsection (1), that the medical personnel is not employed in the Public Service.
- Amendment of section 282
- Omit current section 282 and replace with the following:
- 282 Surgical operations and medical treatment
- A person is not criminally responsible for performing in good faith and with reasonable care and skill a surgical operation or medical
treatment upon any person for his benefit, or upon any unborn child for the preservation of the mother’s life, if the performance
of the operation or treatment is reasonable, having regard to the patient’s state at the time and to all circumstances of the
case.
