Enacted by the Parliament of Nauru as follows:

1. Short title

This Act may be cited as the Criminal Procedure (Amendment) No. 2 Act 2016.

2. Commencement

This Act commences upon certification by the Speaker.

3. Amendment of Criminal Procedure Act 1972

The Criminal Procedure Act 1972 is amended by the provisions of this Act.

4. Amendment of section 162

Section 162 is omitted and substituted with the following:

162 District Court to transfer charges and proceedings to the Supreme Court
(1) Where any charge has been brought against any person of an offence not triable by the District Court or as to which the District Court is of the opinion that it ought to be tried by the Supreme Court, the District Court may transfer the charge and proceedings to the Supreme Court.
(2) An accused person may not be subject to a preliminary inquiry or to committal proceedings prior to the transfer of that person’s case and proceedings to the Supreme Court.
