Legal Practitioners (Amendment) Act 2014

An Act to amend the Legal Practitioners Act 1973

Enacted by the Parliament of Nauru as follows:
This Act may be cited as the Legal Practitioners (Amendment) Act 2014.
This Act commences upon certification by the Speaker.
The Schedule amends the Legal Practitioners Act 1973
SCHEDULE - AMENDMENT OF LEGAL PRACTITIONERS ACT 1973
[1] Insert new section 3A
3A Temporary admission by Registrar
(1) In the absence of the Chief Justice or vacancy of that position, and with the written consent of the Minister, the Registrar may admit to practice temporarily as barrister and solicitor any person duly qualified for admission in accordance with the provisions of this Act.
(2) A person admitted under subsection (1) shall be admitted to practice in respect of only such causes or matters as the Registrar shall direct.
[2] Insert new section 7A
7A Exemption of Government Lawyers
The provisions of admission in this Act shall not apply to the Secretary for Justice and Border Control, the Solicitor General, the Director of Public Prosecutions, the Public Defender, or any appointment or office in the service of the Department of Justice and Border Control. The holding of such office shall in itself constitute admission of such person to practise as a legal practitioner in Nauru.
