AN ACT

To amend the Nauru Phosphate Corporation Act 1969

(Certified: 3rd July, 1978)

SHORT TITLE

1. This Act may be cited as the Nauru Phosphate Corporation (Amendment) Act 1978.

THE PRINCIPAL ACT

2. (1) In this Act "the principal Act" means the Nauru Phosphate Corporation Act 1969.

(2) The principal Act as amended by this Act may be cited as the Nauru Phosphate Corporation Act 1969-1978.

AMENDMENT OF THE PRINCIPAL ACT

3. (1) Section 4 of the principal Act is hereby amended by deleting therefrom the following quotation marks, words, numerals and punctuation -

"the Managing Director" means the Managing Director appointed under Section 19 of this Act;

(2) Section 19 of the principal Act is hereby deleted and the following new Section 19 is hereby inserted in its place -

"The Board may, unless otherwise directed by the Minister, delegate to any officer or employee of the Corporation any of the Board's powers or functions under this Act.
Provided that the delegation of any of the Board's powers or functions under this Act to any officer or employee of the Corporation shall not preclude the Board from itself exercising that power or function."

(3) Section 34 of the principal Act is hereby repealed in its entirety.
