Enacted by the Parliament of Nauru as follows:

1 Short title

This Act may be cited as the Nauru Superannuation (Amendment) Act 2020.

2 Commencement

This Act commences on certification of the Speaker.

3 Amendment of the Nauru Superannuation Act 2018

The Nauru Superannuation Act 2018 is amended by the provisions of this Act.

4 Insert new Section 50A

A new Section 50A is inserted under Part 9 immediately before Section 51 as follows:

50A Exemptions

(1) Notwithstanding any other provisions of this Act, an employer may be exempt from paying the employer’s contribution to the Nauru Super Scheme under this Act.

(2) Where an employer is exempt under subsection (1), such employer may make voluntary contributions to the Nauru Super Scheme in accordance with this Act.

(3) Where an employer is exempt under subsection (1), the employees may pay the members’ contribution to the Nauru Super Scheme in accordance with this Act.

(4) The employers or class of employers exempt from making contributions to the Nauru Super Scheme under this Act are as specified in Schedule 2.

5 Amendment of Schedule

(1) The Schedule is amended by deleting ‘Schedule’ and substituting ‘Schedule 1’.

(2) A new Schedule 2 is inserted as follows:

(3) Schedule 2 may be amended, varied and repealed by the Cabinet.
