An Act to amend the Film and Public Entertainment Act 1979
1. Short Title - This Act may be cited as the Film and Public Entertainment Amendment Act 1992 and shall be read together with and deemed part of the Film and Public Entertainment Act 1979 (herein referred to as "the principal Act")
2. Duty of organiser - The principal Act is amended by repealing section 18.
3. Licensed premises - Section 24 of the principal Act is amended by deleting subsection (3) and substituting the following new subsections –
"(3) A licence granted pursuant to this section may be granted in respect of a particular date or dates, or for a period of time not exceeding one year, and may be granted in respect of public entertainment generally, or for one or more particular types of public entertainment. A licence shall also specify the particular premises at which the public entertainment shall occur, and may be granted subject to such terms and conditions as the Board may determine.
(4) The Board may delegate its functions under this section to one or more of its members, and may at any time revoke such delegation."
4. General penalty - Section 29 of the principal Act is amended, by adding the following new subsection –
"(2) Where any person who is the holder of a licence under section 24 has breached any provision of Parts V, VI or VII of this Act, or a term or condition of any licence issued under section 24, the High Court may, in addition to any other penalty prescribed by law, and after taking into account the views of the Board, and of the licensee, either -
(a) Suspend such licence for such period (not exceeding one month) as the Court thinks fit, or
(b) For a second or subsequent offence, and if it is necessary in the public interest, revoke such licence."
This Act is administered by the Film and Public Entertainment Control Board.
This Act was passed by the Niue Assembly on the 30th day of September 1992.
