BUILDINGS PERMITS ORDINANCE 1959
1959, No.59
An Ordinance to regulate the construction of buildings on Niue (19 March 1959).
1. Short Title - This Ordinance may be cited as the Niue Buildings Permits Ordinance 1959.
2 Interpretation - In this Ordinance unless a different intention appears -
"New building works" includes alterations or additions to existing buildings of permanent construction:
"Permanent materials" means building in timber, iron, cement, or puga, as opposed to pola construction.
3. Building permit to be obtained - Before any new building works can be commenced in permanent materials it is necessary that a Building Permit be first obtained.
4. Application for building permits - All applications for Building Permits must be made to the Public Works Officer, and they must be accompanied by a floor plan and
details of proposed construction and numbers of proposed occupants, adults and children separately.
5. Issue of building permits - Before issuing a Building Permit the Public Work Officer, where necessary, should consult with the Chief Medical Officer to ensure
that the requirements of [the Public Health Ordinance 1965] are complied with. This deals with proper and sufficient ventilation.
[The Public Health Ordinance 1965, being the corresponding enactment in force at the date of this reprint, has been substituted for
the repealed Sanitation Ordinance 1918.]
6. Siting of buildings - The actual siting of the building in relation to other buildings should be shown on the plan submitted with the application. No
permits will be issued unless the proposed dwelling is sited not less than twenty feet from any other dwelling [or ten feet from
a boundary recognised by both landowners, and ten feet from any road line].

7. Inspection of houses - Under this Ordinance there is appointed a Building Inspector who shall be a member of the Public Works Department, and whose duty
it shall be to inspect houses in the course of construction to ensure that any conditions laid down are complied with.
8. Penalties - The penalty for any infringement or breach of this Ordinance shall be a fine not exceeding £50.
