CURFEW ORDINANCE 1950
1950, No.40
An Ordinance to impose restrictions to maintain peace and order in Niue (30 June 1950).
1. Short Title - This Ordinance may be cited as the Niue Curfew Ordinance 1950.
2. Notice to be given in writing publicly - This Ordinance shall be in force in every village in which the Resident Commissioner by notice in writing publicly given in that
village and at the seat of Government directs that it shall be in force.
3. Notice may define village - A notice given under the last preceding section hereof may define the village for the purposes of this Ordinance and the hour of
curfew as provided for in section 4 hereof and may at any time at the discretion of the Resident Commissioner be in like manner withdrawn.
4. Curfew to be sounded - A person from time to time authorised by the Resident Commissioner in that behalf shall sound a curfew in the village every day
at such hour as is stated in the notice referred to in section 2 hereof.
5. Certain restrictions after curfew sounded - After the curfew has been sounded and until daylight on the following day no person shall make or cause or permit to be made a
loud noise in the village and every person resident in the village shall within half an hour retire to the house in which he resides
and no person shall thereafter be abroad without reasonable excuse the burden of proving which shall be on that person.
6. Written permission of Resident Commissioner required - After the curfew has sounded and until daylight on the following day no person shall conduct or assist to conduct or continue to
conduct or be present at any [Niuean] gathering or sports or dancing or exhibition of pictures or any form of fiafia or alaala without
the written permission of the Resident Commissioner.
[The word "Niuean" was substituted for the word "Native" by the Niue Act 1966.]
7. Penalty - Any person guilty of an offence against this Ordinance shall be liable to a fine not exceeding five pounds.
8. Proceedings - In any proceedings for an offence against this Ordinance it shall be presumed in the absence of evidence to the contrary that the
curfew was duly sounded.
9. Repeal - Niue Curfew Ordinance 1950, No. 39, is hereby repealed.
