INDEPENDENT STATE OF PAPUA NEW GUINEA.


AN ACT

entitled

Consular Fees Act 1983,

Being an Act to provide for the charging of fees for consular services performed by various persons, and for related purposes,

MADE by the National Parliament to come into operation in accordance with a notice published in the National Gazette by the Head of State, acting with, and in accordance with, the advice of the Minister.

  1. INTERPRETATION.

In this Act, unless the contrary intention appears –

“consular service” means a service or act specified in the Regulations as being a consular service for the purpose of this Act;

“person entitled to perform consular services” means –

(a) a person appointed to hold or act in any of the following offices of the State in a country or place outside Papua New Guinea –

(i) Ambassador;

(ii) High Commissioner;

(iii) Charge d’Affairs;

(iv) Consul –General;

(v) consul;

(vi) Counsellor or other diplomatic agent attached to a Papua New Guinea Diplomatic Mission; and

(b) the Secretary of the Department responsible for Foreign Affairs and Trade or any person authorized by him to perform consular services;

“this Act” includes the Regulations.

  1. FEES MAY BE PRESCRIBED FOR CONSULAR SERVICES.

The Regulations may provide for the imposition of fees, to be collected on behalf of the State, for the performance, in Papua New Guinea or elsewhere, of consular services by a person entitled to perform consular services.

  1. SAVINGS OF FEES UNDER OTHER ACTS.

A fee under this Act is not chargeable in respect of an act or service for which a fee is chargeable under any other Act, whether passed before or after the commencement of this Act.

  1. REGULATIONS.

The Head of State, acting on advice, may make Regulations, not inconsistent with this Act, prescribing all matters permitted or required to be prescribed by this Act, or necessary or convenient to be prescribed for carrying out or giving effect to this Act.
