Education (International Education Agency Schools) Regulation 1985

Education (International Education Agency Schools) Regulation 1985

ARRANGEMENT OF SECTIONS.

Education (International Education Agency Schools) Regulation 1985

MADE by the Head of State, acting with, and in accordance with, the advice of the National Executive Council under the Education Act 1983.

  1. INTERPRETATION.

In this Regulation, unless the contrary intention appears–

“the Board” means the International Schools Board established under Section 2;

“Chairman” means the Chairman of the Board;

“the International Education Agency” means the Education Agency recognised by that name under Section 55 of the Act on 31 December 1985;

“International Education Agency School” means–

(a) a member International School operated by the International Education Agency and recognised as a National Institution under Section 96 of the Act on 31 December 1985; or

(b) a permitted school which at the request of the International Education Agency has been granted a Certificate of Registration as a Permitted School in accordance with Section 100 of the Act and which the Departmental Head has determined, ought by virtue of its curriculum and enrolment to be subject to this Regulation; or

(c) an International Pre School operated by the International Education Agency on 31 December 1985.

  1. INTERNATIONAL SCHOOLS BOARD.

(1) The International Schools Board is hereby established.

(2) The International Schools Board shall consist of the following members appointed by the Minister–

(a) two persons to represent the interests of the State, one of whom shall be an officer of the Department responsible for education matters; and

(b) two persons appointed from a panel nominated by the International Education Agency to represent the interests of the International Education Agency; and

(c) one person appointed from a panel nominated by the Headteachers’ Conference to represent the views of teaching staff at International Education Agency Schools; and

(d) not more than two other persons with an interest in international education appointed from a panel nominated by the International Education Agency.

(3) A member or alternate member of the International Schools Board holds office for a period of three years.

(4) The Minister shall appoint one of the members to be the Chairman of the Board.

(5) The Minister shall appoint an alternate for each member, on the same terms and conditions as the member for whom he is the alternate.

(6) Persons appointed under Subsection (2)(d) shall not be members of governing bodies or employees of the International Education Agency.

  1. FUNCTIONS OF INTERNATIONAL SCHOOLS BOARD.

The functions of the Board shall be–

(a) to advise the International Education Agency on the fees which may be imposed and charged by the Agency in respect of the schools for which it is responsible; and

(b) to establish the minimum qualifications for teachers employed in International Education Agency Schools; and

(c) to make recommendations to the International Education Agency on appropriate teaching staff establishments in International Education Agency Schools; and

(d) to determine appeals where a person or a governing body has been aggrieved by a decision of the International Education Agency; and

(e) to advise the Minister and the International Education Agency on any matter affecting International Education Agency Schools including the efficiency of schools and the welfare of teachers.

  1. DEPUTY CHAIRMAN OF BOARD.

(1) The members of the International Schools Board shall elect one of their number to be the Deputy Chairman of the Board during the pleasure of the Board.

(2) In the event of the absence or inability to act of the Chairman, the Deputy Chairman has and may exercise all the powers and functions of the Chairman.

  1. MEETINGS OF INTERNATIONAL SCHOOLS BOARD.

(1) The International Schools Board shall meet at least four times in each calendar year.

(2) Subject to Subsection (3) a meeting of the International Schools Board shall be convened by the Chairman by written notice to the other members of the Board and shall be held at a time and place specified in the notice.

(3) The Chairman shall, within six weeks after receiving a request to do so from not less than three members of the International Schools Board, convene a meeting of the Board.

  1. PROCEDURE AT MEETINGS OF INTERNATIONAL SCHOOLS BOARD.

(1) The Chairman shall preside at all meetings of the International Schools Board at which he is present.

(2) In the absence of the Chairman from a meeting, the Deputy Chairman shall preside.

(3) In the absence of both the Chairman and the Deputy Chairman from a meeting, the members present shall elect one of their number to preside at the meeting.

(4) The quorum at a meeting of the International Schools Board is four.

(5) All questions before a meeting of the International Schools Board shall be decided by a majority of votes of the members present and voting.

(6) The member presiding at a meeting of the International Schools Board has a deliberative vote and, in the event of an equality of votes, also has a casting vote.

(7) Subject to this Regulation, the procedure at meetings of the International Schools Board shall be as the Board determines.

(8) The International Schools Board shall cause minutes of its proceedings to be recorded and kept.

  1. COMMITTEES OF INTERNATIONAL SCHOOLS BOARD.

(1) The International Schools Board shall appoint such committees as the Board thinks fit.

(2) A committee shall consist of such member or members of the International Schools Board and such other person or persons (if any) as the Board approves.

(3) A committee established under Subsection (1) shall have such functions and include such representatives as the International Schools Board thinks fit.

(4) The Chairman of the International Schools Board shall appoint a Chairman for each committee of the Board.

(5) The procedures of a committee shall be as determined by the International Schools Board, or, in so far as they are not determined by the Board, decided by the committee.

(6) A committee shall cause minutes of its proceedings to be recorded and kept.

  1. DELEGATION BY INTERNATIONAL SCHOOLS BOARD.

The International Schools Board may, by written instrument, delegate to a committee of the Board all or any of its powers or functions (other than this power of delegation and any other power or function held by the Board under delegation ) under this Regulation, so that the delegated powers and functions may be exercised and performed as specified in the instrument of delegation.

  1. FUNCTIONS OF INTERNATIONAL EDUCATION AGENCY.

The functions of the International Education Agency are–

(a) after receiving advice from the International Schools Board, to impose fees on the parents or guardians of students attending International Education Agency Schools and to direct the governing bodies for those schools to collect fees so imposed for payment into the Agency’s funds for that purpose; and

(b) to establish by-laws concerning–

(i) the establishment, functions and procedures of governing bodies of International Education Agency Schools; and

(ii) the suspension of governing bodies and the procedures to be followed in suspending a governing body; and

(iii) the appointment of teaching staff in International Education Agency Schools; and

(iv) the employment conditions of teaching staff employed in International Education Agency Schools; and

(v) the discipline (including dismissal) of teaching staff in International Education Agency Schools; and

(vi) policies for enrolment and discipline of students attending International Education Agency Schools including the punishment by suspension or expulsion for breaches of discipline; and

(vii) all other matters necessary for the good management of International Education Agency Schools.

  1. REGISTRATION AS PERMITTED SCHOOL.

The International Education Agency shall, within 2 months of the commencement of this Regulation, apply for a Certificate of Registration as a Permitted School in accordance with Section 100 of the Act for each International Education Agency School.

  1. NON-APPLICATION OF REGULATION.

The provisions of Section 8 and Section 12 of the Education Regulation 1983 do not apply to International Education Agency Schools.

  1. EXECUTIVE OFFICER ETC.

The International Education Agency shall appoint a person to be the Executive Officer of the International Schools Board and shall provide adequate administrative, clerical and secretarial services to the Board to ensure the efficient functioning of the Board.

  1. TRANSITIONAL.

The schools which were members of the International Education Agency on 31 December shall on the commencement of this Regulation continue as member schools of the International Education Agency.
