ARRANGEMENT OF SECTIONS.
Firearms Regulation 1980
MADE under the Firearms Act 1978.
Dated 200 .
(1) The Register of Firearms shall be in Form 1.
(2) The Register of Pistol Licences shall be in Form 2.
(3) The Register of High-powered Firearms Licences shall be in Form 3.
(4) The Register of Gun Dealers’/Ammunition Dealers’ Licences shall be in Form 4.
A firearm licence shall be in Form 5.
An owner’s licence shall be in Form 6.
A permit to buy or hire a firearm shall be in Form 7.
A permit to carry a firearm–
(a) under Section 20 of the Act–shall be in Form 8; and
(b) by an employee under Section 23 of the Act–shall be in Form 9.
A pistol licence or a high-powered firearm licence, or a renewal of either of them, shall be in Form 10.
An application for approval or renewal of approval of a gun club, rifle club or pistol club shall be in Form 11.
An approval or renewal of approval of a gun club, rifle club or pistol club shall be in Form 12.
(1) An application for approval or renewal of approval of a firing range shall be in Form 13.
(2) The application for approval of a firing range shall be accompanied by a map and plan of the range showing the situation and boundaries of the firing range.
An approval or renewal of approval for a firing range shall be in Form 14.
(1) An application for a gun dealer’s licence or ammunition dealer’s licence or a renewal of either of them shall be in Form 15.
(2) The application under Subsection (1) shall be accompanied by a statement of particulars required under Section 39(2) of the Act.
A gun dealer’s licence shall be in Form 16.
An ammunition dealer’s licence shall be in Form 17.
(1) The holder of a gun dealer’s licence shall keep a record of his transactions in Form 18.
(2) At least once in every period of six months, or when the Registrar, in a particular case, directs, the holder of a gun dealer’s licence shall forward to the Registrar copies of the entries made in the record kept in accordance with Subsection (1), of which copies have not previously been forwarded in accordance with this section.
The holder of an ammunition dealer’s licence shall keep a record of his transactions in Form 19.
Subject to Section 69 of the Act, where in relation to a firearm, pistol or high-powered firearm–
(a) the Registrar revokes, or refuses to issue or renew a firearm licence, a pistol licence or a high-powered firearm licence; and
(b) an appeal against the revocation or refusal is not pending,
then–
(c) for the purposes of Section 47 of the Act, the person who has possession of the firearm must deliver that firearm to the Registrar within seven days of receipt of the notice of the revocation or refusal; and
(d) for the purposes of Section 48 of the Act, the person who has possession of the pistol or high-powered firearm, as the case may be, must deliver it immediately to a commissioned officer of the Police Force.
Penalty: A fine not exceeding K200.00.
Subject to Section 69 of the Act, where the Registrar revokes, or refuses to issue or renew a gun dealer’s licence, for the purpose of Section 49 of the Act, the person having possession of any firearms held under that licence must–
(a) dispose of the firearms to a person holding a gun dealer’s licence; or
(b) deliver the firearms to a commissioned officer of the Police Force,
within 28 days of receiving the notice of the revocation of, or refusal to issue or renew, the licence.
Penalty: A fine not exceeding K200.00.
For the purpose of Section 63 of the Act, the owner of a firearm registered under the Act–
(a) who changes his address–must, within 14 days of that change, forward to the Registrar a notice in Form 20; and
(b) who sells or otherwise disposes of the firearm–must, within 14 days of the sale or disposal, forward to the Registrar a notice in Form 21.
For the purpose of Section 64 of the Act, the holder of a licence who changes his address must, within 14 days of that change, forward to the Registrar a notice in Form 22.
A permit for possession of a firearm for the purpose of arranging for its disposal under Section 69 of the Act shall be in Form 23.
For the purposes of this Act, the fees are as set out in Schedule 2.
