ARRANGEMENT OF SECTIONS.

National Capital District Commission (Ward Committees) Regulation 1991

MADE by the Head of State acting with, and in accordance with the advice of the National Executive Council under the National Capital District Commission Act 1990.

PART I. – PRELIMINARY.

  1. INTERPRETATION.

In this Regulation, unless the contrary intention appears–

“Commission” means the National Capital District Commission established by Section 3 of the National Capital District Commission Act 1990;

“Committee” means a ward Committee of a ward appointed under Section 3;

“ward” means a ward established under Section 2.

PART II. – WARDS.

  1. ESTABLISHMENT OF WARDS.

(1) For purposes of this Regulation, the Commission shall determine boundaries for wards within the National Capital District.

(2) A maximum of not less than 10 wards shall be established in the National Capital District.

  1. ESTABLISHMENT OF WARD COMMITTEES..

(1) The Commission shall, in respect of each ward, after proper consultation with relevant persons and bodies in the ward area, appoint a Committee to represent the ward.

(2) Each Committee of a ward comprise shall consist of not more than seven members, of whom–

(a) one shall represent the interest of churches; and

(b) one shall represent the interest of businesses; and

(c) one shall represent the interest of women; and

(d) one shall represent the interest of youths; and

(e) one shall represent the interest of settlements; and

(f) two shall represent the interest of the general community.

(3) A member of a Committee appointed under this Section–

(a) shall be permanently resident in the ward area for which he represents; and

(b) shall be appointed for a period of 21 months; and

(c) is eligible for re-appointment.

(4) Members of a Committee shall not be entitled to receive any fees and allowances, other than,–

(a) a sitting allowance of K20.00 for each meeting they attend; and

(b) free transportation to and from their place of residence to the place of the meeting.

  1. VACATION OF OFFICE.

(1) A member of the Committee may be removed from office by the Commission in the event that he–

(a) commits a criminal offence; or

(b) fails without consent of the Chairman to attend three consecutive meetings of the Committee to which he is a member; or

(c) ceases to be a resident of his ward; or

(d) tenders his resignation to the Commission in writing.

(2) In the event of a vacancy in the office of a member of a Committee under Subsection (1), the Commission shall, after proper consultation, make an appointment of a suitable person to fill the vacancy in accordance with Section 3.

  1. CHAIRMAN AND DEPUTY CHAIRMAN OF WARD COMMITTEES.

(1) The members of a Committee shall appoint a member from amongst the members to be the Chairman and another member of the Committee to be Deputy Chairman of the Committee.

(2) At a meeting of the Committee the Chairman, or in his absence the Deputy Chairman, shall preside, and in the absence of both the Chairman and the Deputy Chairman, the members shall appoint a Chairman amongst their own number.

  1. FUNCTIONS OF WARD COMMITTEES.

(1) Subject to this Regulation, the functions of a Committee of a ward are–

(a) to advise the Commission in respect of matters that affect areas within the ward area; and

(b) to be responsible for communicating the Commission’s decisions, policies and initiatives to the communities within the ward area; and

(c) such other functions as are determined by the Commission from time to time.

(2) A Committee shall not be entitled to raise, expend, maintain, or in any way deal with, funds.

  1. MEETINGS OF WARD COMMITTEES.

(1) At a meeting of a Committee–

(a) four members are a quorum; and

(b) subject to this Regulation, proceedings at a meeting shall be determined by the members; and

(c) all matters arising at the meeting shall be decided by a simple majority of votes of the members present and voting, and in the event of an equality of votes on a matter, the member presiding has also a casting vote.

(2) Unless there is no business for consideration, the Committee shall meet at such time and place as the Chairman shall determine, but in any event not less than once in every month.

(3) The Commission shall appoint an officer of the Commission to–

(a) be responsible, in consultation with the Chairman of a Committee, for organizing the meeting of the Committee; and

(b) be responsible for keeping accurate records of minutes of the meetings of Committee; and

(c) be responsible for tabling of the meetings at the next meeting of the Commission.
