INDEPENDENT STATE OF PAPUA NEW GUINEA.
AN ACT
entitled
Public Service (Oversea Agencies) Act 1973,
Being an Act to make provision regarding certain offices in the Public Service arising out of the carrying out of agency functions on behalf of the Government by oversea agencies.
In this Act, unless the contrary intention appears–
“agency function” means a function of the Government carried out on its behalf by an oversea agency;
“designated office” means an office designated under Section 3;
“the designated oversea agency”, in relation to a designated office, means the oversea agency to which this Act applies declared by the Minister under Section 2 to be the designated oversea agency in relation to that office;
“oversea agency” means–
(a) the government, a government department or a government agency of a country other than Papua New Guinea; or
(b) a corporation incorporated under the law of a country other than Papua New Guinea; or
(c) an international agency;
“oversea agency to which this Act applies” means an oversea agency declared under Section 2 to be an oversea agency to which this Act applies.
The Minister may, by notice in the National Gazette, declare an oversea agency to be an oversea agency to which this Act applies.
[1]Where an oversea agency to which this Act applies advises the Minister that in its opinion it is necessary for the proper carrying out of the agency functions for which the agency is responsible that the provisions of this Act apply to and in relation to an office, the Minister may, by notice in the National Gazette, declare the office to be a designated office for the purposes of this Act, and the oversea agency to be the designated oversea agency in relation to the office.
In the application of the Public Services (Management) Act 1995 to and in relation to a designated office–
(a) a person nominated by the designated overseas agency shall be an additional member of the Public Service Selection Committee; and
(b) Section 51 of that Act does not prevent the disclosure to the designated overseas agency of any matter by the person nominated under Paragraph (a); and
(c) in the event of an equality of votes on a matter before the Public Service Selection Committee, the Chairman has a casting, as well as a deliberative, vote.
