INDEPENDENT STATE OF PAPUA NEW GUINEA.
AN ACT
entitled
Sale of Human Blood Act 1965,
Being an Act to prohibit unauthorized trading in human blood.
(1) Subject to this section, a person who buys, agrees to buy, offers to buy or holds himself out as being willing to buy, human blood or the right to take blood from the body of another person is guilty of an offence.
Penalty: A fine not exceeding K200.00 or imprisonment for a term not exceeding six months, or both.
(2) Where he thinks it desirable by reason of special circumstances to do so, the Minister may, by notice in the National Gazette, authorize, subject to such conditions and restrictions as are specified in the notice, a person to buy human blood or the right to take blood from the body of another person.
(3) A person who fails to comply with a condition, or acts contrary to a restriction, specified in a notice under Subsection (2) is guilty of an offence.
Penalty: A fine not exceeding K100.00.
A person who knowingly–
(a) publishes or disseminates by newspaper, book, broadcasting, cinematograph or other means; or
(b) exhibits to public view; or
(c) deposits in or on the area, yard, garden or enclosure of a house, shop or place or a vehicle,
an advertisement relating to the buying in the country of human blood or of the right to take blood from the bodies of persons is guilty of an offence unless the advertisement and the form and wording of the advertisement have been approved by the Minister and the advertisement contains a statement to that effect.
Penalty: A fine not exceeding K200.00 or imprisonment for a term not exceeding three months, or both.
(1) Subject to this section, a person who sells or agrees to sell human blood (including his own blood), or the right to take blood from his body or that of another, is guilty of an offence.
Penalty: A fine not exceeding K100.00.
(2) Subsection (1) does not apply to or in relation to a sale or agreement to sell to a person who is, or is reasonably believed by the vendor to be, acting in, or for the purpose of, the exercise of an authority under Section 1(2).
Proceedings for an offence against this Act shall not be taken without the consent of the Minister.
