AN ACT
entitled
Customs (2008 Budget Amendment) Act 2007,
Being an Act to amend the Customs Act (Chapter 101),
MADE by the National Parliament and deemed to come into operation on 1 January 2008.
1. CUSTOMS SECURITIES (AMENDMENT OF SECTION 14).
Section 14 of the Principal Act is amended in Subsection (4) by repealing the figure and word "12 months" and replacing them with the following words:-
"two years".
2. SECURITY, ETC., FOR RE-EXPORT (AMENDMENT OF SECTION 107).
Section 107 of the Principal Act is amended –
(a) in Subsection (3)(a)(iii) by repealing the words "three months" and replacing them with the following words:–
"twelve months"; and
(b) in Subsection (4)(b) by repealing the words "three months" and replacing them with the following words:–
"twelve months".
3. NOTICE OF PROCEEDINGS AGAINST OFFICERS (AMENDMENT OF SECTION 140).
Section 140 of the Principal Act is amended –
(a) in Subsection (1) by repealing the words and comma:–
"Subject to Subsection (5),"; and
(b) by repealing Subsections (5) and (6).
4. COLLUSION AND SIMILAR OFFENCES BY OFFICERS, ETC., (AMENDMENT OF SECTION 157).
Section 157 of the Principal Act is amended:-
(a) by inserting in Paragraph (c)(ii) after the words and comma "the seizure," the following word: –
"or"; and
(b) by inserting the following new paragraph:-
"(d) conspires or connives with any person to import or export, or is in any way concerned in the importation or exportation of, any goods for the purposes of facilitating any clearance of goods –
(i) to evade the payment of any customs duty, or
(ii) in contravention of the Customs (Prohibited Imports) Regulations or the Customs (Prohibited Exports) Regulations,".
