AN ACT
Entitled
Education (Amendment) Act 2020,
Being an Act to amend the Education Act 1983,
MADE by the National Parliament to come into operation in accordance with a notice in the National Gazette by the Head of State, acting with, and in accordance with, the advice of the Minister.
Section 2 of the Principal Act is amended -
(a) by repealing the definition of "the Commission for Higher Education", "national institution" and "school" and replacing them with the following new definitions:
- "national institution" means -
- (a) a national high school; and
- (b) a member school that is declared by the Minister to be a national institution under the authority of the National Education Board; and
- (c) all schools in the National Capital District;
- "school" means an institution for providing -
- (a) pre-school education; or
- (b) community school education; or
- (c) elementary school education; or
- (d) primary school education; or
- (e) secondary school education; or
- (f) high school education; or
- (g) technical education to Grade 12 only; or
- (h) vocational training to Grade 12 only; or
- (i) correspondence education to Grade 12 only; or
- (j) self-help education to Grade 12 only; or
- (k) all other types of education to Grade 12 only, but does not include -
- (i) a religious institution; or
- (ii) an institution conducted by the State that is not placed by the State under the Authority of the Department;"; and
- "the National Higher and Technical Education Board" means the National Higher and Technical Education Board established under Section 13 of the Higher Education (General Provisions) Act 2014;
(b) by repealing Paragraphs (a) and (e) from the definition of "technical school".
Section 17 of the Principal Act is amended in Subsection (2) by repealing the words "Commission for Higher Education" and replacing them with the words "Department of Higher Education, Research Science and Technology".
Section 27 of the Principal Act is amended by repealing Subsection (5) and replacing it with the following:
"(5) Where the Minister makes a determination under Subsection (1) in relation to an institution or institutions of higher education under the Higher Education (General Provisions) Act 2014, he must, before making such a determination, consult with the Minister responsible for Higher Education, Research, Science and Technology.".
Section 72 of the Principal Act is amended -
(a) in Subsection (1)(d), by repealing Sub-paragraph (viii) and replacing it with the following:
- "(viii) in the case of schools providing technical education - the University of Technology or other appropriate higher education institution; and;" and
(b) by repealing Subsection (4).
Section 96 of the Principal Act is amended in Subsection (1) by repealing Paragraph (d).
Section 103 of the Principal Act is repealed.
