Institute of Applied Social and Economic Research (Amendment) Act 1993

AN ACT

entitled

Institute of Applied Social and Economic Research (Amendment) Act 1993,

Being an Act to amend the Institute of Applied Social and Economic Research Act (Chapter 165),

MADE by the National Parliament.

1. NEW TITLE.

The Principal Act is amended by -

(a) repealing the short title "Institute of Applied Social and Economic Research Act" and replacing it with "National Research Institute Act"; and
(b) repealing from the long title the words "Institute of Applied Social and Economic Research" and replacing them with "National Research Institute".

2. INTERPRETATION (AMENDMENT OF SECTION 1).

Section 2 of the Principal Act is amended by -

(a) inserting before the definition of "the by-laws" the following new definition:-

• "'government' means national government, provincial government, local level government, and any other levels of government;"; and

(b) repealing the definition of "the Institute" and replacing it with the following new definition:-

• "'the Institute' means the National Research Institute established by Section 2;".

3. ESTABLISHMENT OF THE INSTITUTE (AMENDMENT OF SECTION 2).

Section 2 of the Principal Act is amended by adding the following new subsection:-

"(3) With effect from the coming into operation of the Institute of Applied Social and Economic Research (Amendment) Act 1993, the name of the Institute of Applied Social and Economic Research shall be changed to the National Research Institute.".

4. INCORPORATION OF THE INSTITUTE (AMENDMENT OF SECTION 3).

Section 3(a) of the Principal Act is amended by repealing the words "Papua New Guinea Institute of Applied Social and Economic Research" and replacing them with the words "National Research Institute".

5. OBJECTS OF THE INSTITUTE (AMENDMENT OF SECTION 5).

Section 5(c) of the Principal Act is repealed and is replaced with the following:-

"(c) where practicable, the provision, by agreement with the government, person or body concerned, of consultancy services to governments (and to Departments, authorities and instrumentalities of governments) and to other persons and bodies (whether governmental bodies or otherwise);".

6. MEETING OF THE COUNCIL (AMENDMENT OF SECTION 6).

Section 12 of the Principal Act is amended in Subsection (1) by deleting the word "four" and substituting the word "three".

7. NEW SECTION 12A.

The Principal Act is amended by adding after Section 12 the following section:-

"12A. COUNCIL TO MEET COSTS OF TRAVEL.
Where a member of the Council is attending a meeting of the Council, and he is not ordinarily resident in Port Moresby, the Council shall pay for any costs of travel and accommodation incurred by him.".

8. APPOINTMENT OF STAFF (AMENDMENT OF SECTION 23).

Section 23 of the Principal Act is amended by adding the new subsection:-

"(4) Subject to the Salaries and Conditions Monitoring Committee Act 1988, the terms and conditions of employment of the members of staff of the Institute as are provided in the by-laws.".

9. TRANSFER OF ASSETS, ETC., TO THE INSTITUTE.

(1) All assets held by, and all obligations and liabilities imposed on -

(a) the Institute of Papua New Guinea Studies established under the Cultural Development Act (Chapter 153) (Repealed); and
(b) the Educational Research Unit established by the University of Papua New Guinea,

immediately before their amalgamation with the Institute, are, on that amalgamation, deemed to have been transferred to the Institute.

(2) Where any property vested in the -

(a) Institute of Papua New Guinea referred to in Subsection (1) (a); and
(b) the Education Research Unit referred to in Subsection (1) (b),

is land registered under the Land Registration Act (Chapter 191), the Registrar of Title, shall, without formal transfer and without fee, on application in that behalf by the National Research Institute, enter on register the Institute in the Register kept under that Act and on entry and registration grant a certificate of title, lease or other instrument evidencing title to the land.

10. NEW NAME SUBSTITUTED.

In the construction and for the purposes of any law, an Act, judgement or document passed or made before the change of name of the Institute to the National Research Institute effected by this Act, but so far only as may be necessary for the purpose or in consequence of such change of name, the name of the National Research Institute shall be substituted for the name of the Papua New Guinea Institute of Applied Social and Economic Research.
