SCHEDULE.
AN ACT
entitled
National Capital District Commission (Amendment) Act 1994,
Being an Act to amend the National Capital District Commission Act 1990,
MADE by the National Parliament to come into operation in accordance with a notice in the National Gazette by the Head of State, acting with, and in accordance with, the advice of the Minister.
Section 5 of the Principal Act is repealed and replaced with the following:-
"5. LORD MAYOR AND DEPUTY LORD MAYOR.
(1) The Minister shall appoint from the members holding office under -
- (a) Section 4(1)(a), subject to Subsection (2) -
- (i) a member to be the Lord Mayor; and
- (ii) a member to be the alternate Lord Mayor; and
- (b) Section 4(1)(c) -
- (i) a member to be the Deputy Lord Mayor; and
- (ii) a member to be the alternate Deputy Lord Mayor.
"(2) A member holding office under Section 4(1)(a) shall not be appointed as the Lord Mayor or the alternate Lord Mayor if he is -
- (a) a Minister; or
- (b) the Speaker or Deputy Speaker of the National Parliament; or
- (c) a Vice-Minister; or
- (d) the Leader or Deputy Leader of the Opposition in the National Parliament; or
- (e) a Chairman of a Parliamentary Committee.
"(3) Subject to Parliamentary duties in the case of a member holding office under Section 4(1)(a) and (c), the Lord Mayor, the alternate Lord Mayor, the Deputy Lord Mayor and the alternate Deputy Lord Mayor shall serve on a full-time basis and shall be paid such fees and allowances and receive such benefits as are determined -
- (a) in the case of a member holding office under Section 4(1)(a) - by the Salaries and Remuneration Commission; and
- (b) in the case of a member holding office under Section 4(1)(c) - by the Minister.
"(4) The Lord Mayor, the alternate Lord Mayor, the Deputy Lord Mayor, the alternate Deputy Lord Mayor respectively hold office from the date of their appointment until -
- (a) they cease to be members; or
- (b) the Minister otherwise terminates their appointment; or
- (c) they are appointed to a position specified in Subsection (2).".
Section 10 of the Principal Act is amended in Subsection (3) -
(a) by repealing Paragraph (a) and replacing it with the following:-
"(a) nine members are a quorum;" and
(b) by repealing Paragraph (b) and replacing it with the following:-
- "(b) The Lord Mayor, or in his absence the alternate Lord Mayor, or in his absence the Deputy Lord Mayor, or in his absence the alternate Deputy Lord Mayor shall preside; and in the absence of the Lord Mayor, the alternate Lord Mayor, the Deputy Lord Mayor and the alternate Deputy Lord Mayor, the members shall appoint a Chairman from amongst their own number;".
The Principal Act is further amended in accordance with the Schedule.
