AN ACT

entitled

National Capital District Commission (Amendment) Act 2007,

Being an Act to amend the National Capital District Commission Act 2001.

MADE by the National Parliament.

1. AMENDMENT OF LONG TITLE.

The long title of the Principal Act is amended by deleting after the words "the National Capital District Commission" the words "and the Motu Koitabu Council".

2. INTERPRETATION (AMENDMENT OF SECTION 2).

Section 2 of the Principal Act is amended by repealing the definition of –

(a) "Council" and replacing it with the following:-

"Council" means the Motu Koita Assembly established by the Motu Koita Assembly Act 2007; and

(b) "Motu Koitabu" and replacing it with the following:-

"Motu Koitabu" means the peoples known as Motu and Koita who are customary landowners who are residents within the National Capital District; and

(c) "Motu Koitabu areas" and replacing it with the following:-

"Motu Koita areas" means the areas declared by the Minister by notice in the National Gazette to be Motu Koita areas for the purposes of this Act; and

(d) "Motu Koitabu Council" and replacing it with the following:-

"Motu Koitabu Council" means the Motu Koita Assembly established Under the Motu Koita Assembly Act 2007;

3. REPEAL AND REPLACEMENT OF SECTION 3.

Section 3 of the Principal Act is repealed and replaced with the following:-

"3. GOVERNMENT SYSTEM OF NATIONAL CAPITAL DISTRICT.

(1) A system of government for the National Capital District is hereby established.

(2) The Government of the National Capital District shall be the National Capital District Commission.

(3) The powers, functions and composition of the National Capital District Commission shall be as specified in this Act".

4. NEW SECTION 33A.

The Principal Act is amended by adding after Section 33 the following new section:-

"33A. FINANCIAL ASSISTANCE TO MOTU KOITA ASSEMBLY.

The Commission shall pay to the Motu Koita Assembly a minimum of 10% of the Goods and Services Tax refunded to the Commission in a fiscal year by the Internal Revenue Commission",

5. REPEAL OF PART IX.

Part IX of the Principal Act is repealed.
