AN ACT TO PRESCRIBE THE TERMS AND CONDITIONS OF SERVICE OF HOLDERS OF CONSTITUTIONAL OFFICES

Short Title

1. This Act may be cited as the Constitutional Offices (Terms and Conditions of Service) Act.

Salaries Schedule

2. The Minister may by order prescribe the annual or daily salary, as the case may be, that shall be paid to the holder of an office specified in the Schedule.

Regulations

3. The Minister may make regulations in respect of the terms and conditions of service (including housing and transportation) to which the holder of an office specified in the Schedule is entitled.

Payments charged on Consolidated Fund

4. All payments required by virtue of the provisions of this Act shall be charged and defrayed out of the Consolidated Fund.

THE CONSTITUTIONAL OFFICES (TERMS AND CONDITIONS OF SERVICE) (GOVERNOR-GENERAL) REGULATIONS

Citation

1. These Regulations may be cited as the Constitutional Offices (Terms and Conditions of Service) (Governor-General) Regulations

Salary

2.—(1) The Governor-General shall be paid an annual salary of $40,000.00.

(2) The salary paid to the Governor-General shall be exempted from income tax.

(3) The spouse of the Governor-General shall be paid an allowance of $5,000 per annum which shall be subject to tax.

Housing

3. The Governor-General shall be provided with an official residence which shall be free of rent.

Utilities

4. The cost of water, gas, electricity and telephone provided to the Governor-General's official residence shall be paid for by the Government.

Domestic staff

5. The Governor-General shall be provided with two police drivers and all other employees shall be provided under the establishment and non-establishment registers of the Office of Governor-General.

Transport

6. The Governor-General shall be provided with four vehicles free of charge.

Annual leave

7.—(1) The Governor-General shall be entitled to forty-two days leave for every year of service which shall be taken during the year in which it accrues.

Passage local

8.—(1) The Governor-General and the members of his family shall be provided with free air or sea passages, as appropriate, from Honiara to his place of domicile and return passages to Honiara.

(2) The maximum number of passages per calendar year shall not exceed six.

(3) In this regulation 'place of domicile' includes place of domicile of spouse.

Local travel expenses

9.—(1) When the Governor-General is on official local tour the Government shall meet all official costs, (including meals) and be paid an allowance of forty dollars per day.

(2) Where the spouse of the Governor-General accompanies the Governor-General on an official local tour the spouse shall be entitled to a daily allowance of forty dollars.

Overseas travel

10.—(1) Subject to the provisions of paragraph (2), the Governor-General shall be entitled on official overseas travel to an allowance equivalent to the allowance paid to the Prime Minister on official overseas travel.

(2) Where the cost of the travel is met by a host country or any other source, the Governor-General shall be entitled to fifty per cent of the allowance prescribed in paragraph (1).

(3) Where the spouse of the Governor-General accompanies the Governor-General on an official overseas visit, the spouse shall be entitled to the same allowances as prescribed in paragraphs (1) or (2), as the case may be.

Class of travel (overseas visits)

11.—(1) The Governor-General shall be entitled to travel first class on all official visits overseas.

(2) The spouse of the Governor-General shall be entitled to travel first class on overseas visits when accompanying the Governor-General on such visits.

Appointment grant

12.—(1) The person appointed as Governor-General shall be entitled on his first appointment to a tax-free grant of six thousand dollars.

(2) On the first appointment of a person to the Office of the Governor-General, the spouse of such person shall be entitled to a grant of three thousand dollars.

Entertainment allowance

13. The Governor-General shall be entitled to eight thousand dollars as entertainment allowance per annum.

Clothing allowance

14.—(1) The Governor-General shall be entitled on first appointment to a clothing allowance at the rate of $500 and thereafter at the rate of $200 for each year of service.

(2) On the first appointment of a person to the Office of the Governor-General, the spouse of such person shall be entitled to clothing allowance at the same rate as prescribed in paragraph (1).

Medical treatment

15. The Governor-General, his spouse and children shall be entitled to medical treatment free of charge in Government hospitals. Where overseas medical treatment is recommended by the Chief Consultant, the Government shall bear the cost of such expenses.

Personal loan guarantee

16. The Governor-General shall be eligible for a Government-guaranteed loan, the amount of which shall not be more than eighty thousand dollars.

Baggage

17. Where the Governor-General ceases to hold office the cost of transporting his personal effects shall be met by the Government.

NPF contributions

18. The Governor-General shall contribute to the National Provident Fund as required under the provisions of the National Provident Fund Act.

Death during term of office

19. In the event of the Governor-General dying during the tenure of his office the Government shall be responsible for all funeral expenses and all other expenses incidental thereto.

Terminal grant

20. The Governor-General shall be entitled to a tax-free terminal grant of $14,000.00 on termination of his appointment.

Security

21. The Government shall be responsible for providing adequate security at the residence of the Governor-General.

Citation

1. These Regulations may be cited as the Constitutional Offices (Terms and Conditions of Service) (Speaker) Regulations.

Term of office

2. Subject to the provisions of section 64 of the Constitution, the term of Speaker shall be a period of four years.

Duties

3. The duties of the Speaker shall be as prescribed under section 65 of the Constitution and the Standing Orders of the National Parliament.

Salary

4. The Speaker shall be paid a taxable salary of $62,673.03 per annum.

NPF contributions

5. The Speaker shall make contributions to the National Provident Fund as required under the provisions of the Solomon Islands National Provident Fund Act.

6. The Speaker shall be provided with an official residence free of rent.

Utilities

7. The cost of water, gas and electricity provided to the Speaker's official residence shall be paid for by the Government.

Domestic staff

8. The wages payable for the services of a driver, gardener and domestic helper shall be paid for by the Government.

9. The Speaker shall be provided with a vehicle free of charge.

10. The Speaker shall be entitled to leave at the rate of three and a half days a month (forty-two days per annum) for every year of service, which shall be taken during the year in which it accrues.

11. The Speaker and members of his family shall be provided with free air or sea passages, as appropriate, from Honiara to his place of domicile and return passages to Honiara when proceeding on annual or compassionate leave.

Overseas travel allowances

12.—(1) Subject to the provisions of paragraph (2), the Speaker shall be entitled on official overseas travel to an allowance equivalent to that payable to Ministers under the Members of Parliament (Entitlements) Commission Regulations.

(2) Where the cost of the travel is met by a host country or any other source, the Speaker shall be entitled only to fifty per cent of the allowance as prescribed for Ministers in the Members of Parliament (Entitlements) Commission Regulations.

(3) Where the wife of the Speaker accompanies him on an official overseas visit, the wife shall be entitled to the same allowance as prescribed in paragraphs (1) or (2), as the case may be.

Class of travel (overseas visits)

13.—(1) The Speaker shall be entitled to travel first class on all official visits overseas.

(2) The wife of the Speaker shall be entitled to travel first class on overseas visits provided she accompanies the Speaker on such visits.

Appointment grant

14. The person appointed as Speaker shall be entitled on his first appointment to an appointment grant of $2,000.00.

Clothing allowance

15. The Speaker shall be entitled to a clothing allowance as is payable to Ministers of the Government in accordance with the Members of Parliament (Entitlements) Commission Regulations.

Entertainment allowance

16. The Speaker shall be entitled to an entertainment allowance of $4,000.00 per annum.

Medical treatment

17. The Speaker shall be entitled to medical treatment in accordance with the terms set out for Ministers in the Members of Parliament (Entitlements) Commission Regulations.

Personal loan guarantee

18. The Speaker shall be eligible for a Government-guaranteed loan on the same terms and conditions as set out for Ministers under the Members of Parliament (Entitlements) Commission Regulations.

Baggage allowance

19. A baggage allowance as prescribed in General Orders shall be payable to the Speaker.

Death during incumbency

20. Where a person dies while he is the Speaker the Government shall bear all funeral expenses and other expenses incidental thereto.

Charge allowance

21. The Speaker acting in the office of the Governor-General under section 28 of the Constitution shall be entitled to be paid a charge allowance as prescribed by General Orders.

Terminal grant

22. The Speaker shall be entitled to a terminal grant of $7,000.00 at the end of the term of his office.

Citation

1. These Regulations may be cited as the Constitutional Offices (Terms and Conditions of Service) (Chief Justice) Regulations.

Term of office

2. The term of office of the Chief Justice shall be subject to the provisions of Section 80 of the Constitution.

Duties

3. The duties of the Chief Justice shall be as prescribed under Part II of Chapter VII of the Constitution.

Salary

4. The Chief Justice shall be paid a taxable salary of $64,397.18 per annum.

NPF contributions

5. The Chief Justice shall make contributions to the National Provident Fund as required under the provisions of the Solomon Islands National Provident Fund Act.

7. The cost of water, gas and electricity provided to the Chief Justice's official residence shall be charged to public funds and be paid for by the Government.

8. The wages payable for the services of a driver, and two domestic employees shall be charged to public funds and paid for by the Government.

Vehicle

9. The Chief Justice shall be provided with a vehicle free of charge.

Leave

10. The Chief Justice shall be entitled to leave at the rate of three and half days a month (forty-two days per annum) for every year of service, which shall be taken during the year in which it accrues.

Passages

11.—(1) The Chief Justice and members of his family shall be provided with free air or sea passages, as appropriate, from Honiara when proceeding on annual leave to his place of domicile and return passages to Honiara.

(2) In this regulation 'place of domicile' includes place of domicile of his spouse outside Solomon Islands, if the spouse is not a citizen of Solomon Islands.

Overseas travel allowance

12.—(1) The Chief Justice shall be entitled on official overseas travel to a daily allowance of US$55.00 or one-fifth of the daily allowance, if the travel is externally funded.

(2) Where the spouse of the Chief Justice accompanies him on an official overseas visit, the spouse shall be entitled to claim subsistence allowance at the rate payable to the Chief Justice under paragraph (1).

Class of travel (overseas visits)

13.—(1) The Chief Justice shall be entitled to travel first class on all official visits overseas.

(2) The spouse of the Chief Justice shall be entitled to travel first class on all overseas visits provided she accompanies the Chief Justice on such visits.

Local travel allowance

14. The Chief Justice shall be entitled to a daily allowance of $40 whilst on official travel within Solomon Islands.

Appointment grant

15. The person appointed as Chief Justice shall be entitled on his first appointment to an appointment grant of $4,000.

Clothing allowance

16. The Chief Justice shall be entitled to an outfit allowance of $500 when travelling overseas. The allowance may be claimed once every three years.

Entertainment allowance

17. The Chief Justice shall be entitled to an entertainment allowance of $6,000 per annum.

Medical treatment

18. The Chief Justice shall be entitled to medical treatment in accordance with the terms set out from time to time for public officers.

Personal loan guarantee

19. The Chief Justice shall be eligible for a Government-guaranteed loan, the maximum amount which shall not exceed his annual basic salary.

Citation

1. These Regulations may be cited as the Constitutional Offices (Terms and Conditions of Service) (Puisne Judge) Regulations.

Term of office

2. The term of office of the Puisne Judge is subject to the provisions of section 80 of the Constitution.

Duties

3. The functions of the Puisne Judge shall be as prescribed under Part II of Chapter VII of the Constitution.

Salary

4. The Puisne Judge shall be paid a taxable salary of $60,948.90 per annum.

NPF contributions

5. The Puisne Judge shall contribute to the National Provident Fund as required under the provisions of the Solomon Islands National Provident Fund Act.

12. The Puisne Judge shall be entitled to two return trips either by sea or air within Solomon Islands on compassionate leave per annum.

13.—(1) The Puisne Judge shall be entitled on official overseas travel to a daily allowance of US$55.00 or one-fifth of the daily allowance if such travel is externally funded.

(2) Where the spouse of the Puisne Judge accompanies him on an official overseas visit, the spouse shall be entitled to claim subsistence allowance at the rate payable to the Puisne Judge under paragraph (1).

(2) The spouse of the Puisne Judge shall be entitled to travel first class on all overseas visits when accompanying the Puisne Judge on such visits.

Citation

1. These Regulations may be cited as the Constitutional Offices (Terms and Conditions of Service) (Chairman of Public Service Commission) Regulations.

Term of office

2. Subject to the provisions of section 115 of the Constitution, the term of office of Chairman shall be not less than three nor more than six years.

Duties

3. The duties of the Chairman shall be as prescribed under Chapter XIII of the Constitution.

Salary

4. The Chairman shall be paid an annual taxable salary of $59,224.75.

NPF contributions

5. The Chairman shall contribute to the National Provident Fund as required under the provisions of the Solomon Islands National Provident Fund Act.

6. The Chairman shall on first appointment be paid an appointment grant of $2,000.00.

Housing

7. The Chairman shall be provided with official residence free of rent.

9. Services of one domestic employee shall be charged to public funds and be paid for by the Government.

Vehicle

10. The Chairman shall be provided with one government vehicle free of charge.

Leave

11. The Chairman shall be entitled to annual leave at the rate of three and half days a month or forty-two days per annum for every year of service, which shall be taken during the year in which it accrues.

Compassionate leave

12. The Chairman shall be entitled to two return trips either by sea or air on compassionate leave per annum.

Passage

13.—(1) The Chairman and members of his family shall be provided with passages as appropriate to his place of domicile and return passages to Honiara when proceeding on annual leave.

(2) In this regulation 'place of domicile' includes place of domicile of the spouse.

Overseas travel

14.—(1) The Chairman shall be entitled to a daily allowance of US$55.00 whilst on overseas travel or one-fifth of the daily allowance if such travel is externally funded.

(2) Where the Chairman is a guest of a host government, administration or agency and is not called upon to meet costs for accommodation and meals, he may claim subsistence allowance at one-fifth of the standard rate applicable to public officers under General Orders.

Local travel

15. The Chairman shall be entitled to a daily allowance of $40.00 whilst on official travel within Solomon Islands.

Class of travel

16.—(1) The Chairman shall be entitled to travel first class on all official visits overseas.

(2) The spouse of the Chairman shall be entitled to travel first class on official visits overseas when accompanying the Chairman on such visits.

(3) The spouse shall be entitled to claim subsistence allowance at the rate payable to the Chairman under regulation 14(2).

Outfit allowance

17. The Chairman shall be entitled to an outfit allowance of $500.00 when travelling overseas on official visits. Such allowance may be claimed once every three years.

Entertainment allowance

18. The Chairman shall be entitled to an entertainment allowance from the Prime Minister's Vote for entertainment. The amount of the allowance shall be as declared by the Accounting Officer.

Medical treatment

19. The Chairman shall be entitled to medical treatment in accordance with the terms prescribed from time to time for public officers.

Personal loan guarantee

20. The Chairman shall be entitled to a Government-guaranteed loan, the amount of which shall not exceed his annual basic salary at the time of application.

Baggage allowance

21. A baggage allowance as prescribed from time to time by General Orders shall be payable.

Death during incumbency

22. Where the Chairman dies whilst in office the Government shall pay for all funeral expenses and all other expenses incidental thereto.

Miscellaneous benefits

23. The Chairman shall be entitled to all other benefits available to public officers under the General Orders or other regulations which are not covered under these Regulations.

Terminal grant

24.—(1) Subject to the provisions of paragraph (2), the Chairman shall be entitled to a terminal grant of seven thousand dollars on expiration of his term of office.

(2) Any accumulated debts shall be offset from the grant specified under the provisions of paragraph (1).

Citation

1. These Regulations may be cited as the Constitutional Offices (Terms and Conditions of Service) (Ombudsman) Regulations.

Term of office

2. Subject to the provisions of Section 96 of the Constitution, the term of Office of the Ombudsman shall be a period of five years.

Duties

3. The duties of the Ombudsman shall be as prescribed under Chapter IX of the Constitution.

Salary

4. The Ombudsman shall be paid an annual taxable salary of $59,224.75.

NPF contributions

5. The Ombudsman shall make contributions to the National Provident Fund as required under the provisions of the Solomon Islands National Provident Fund Act.

Cap. 109

Appointment grant

6. The Ombudsman shall on first appointment receive an appointment grant of $2,000.00.

Housing

7. The Ombudsman shall be entitled to rent-free Government accommodation.

Utilities

8. The cost of water, gas and electricity provided to the residence of the Ombudsman shall be charged to public funds and be paid for by the Government.

Domestic staff

9. The wages payable for the services of one domestic employee shall be charged to public funds and be paid for by the Government.

Vehicle

10. The Ombudsman shall be provided with a Government vehicle free of charge.

Leave

11. The Ombudsman shall be entitled to leave at three and half days a month or forty-two days per annum for every year of service, which leave shall be taken during the year in which it accrues.

(2) Where the Ombudsman is a guest of a host government, administration or agency and is not called upon to meet costs for accommodation and meals, he may claim subsistence allowance at one-fifth of the standard rate as applicable to public officers under the General Orders.

17. The Ombudsman shall be entitled to an outfit allowance of $500 when travelling overseas on official business. Such allowance may be claimed once every three years.

18. The Ombudsman shall be entitled to an entertainment allowance from the Prime Minister's Vote for entertainment. The amount of the allowance shall be as determined by the Accounting Officer.

Citation

1. These Regulations may be cited as the Constitutional Offices (Terms and Conditions of Service) (Director of Public Prosecutions) Regulations.

Term of office

3. The duties of the Director of Public Prosecutions shall be as laid down in Section 91 of the Constitution.

4. The Director of Public Prosecutions shall be paid an annual taxable salary of $59,224.75.

NPF contributions

5. The Director of Public Prosecutions shall make contributions to the National Provident Fund as required under the provisions of the Solomon Islands National Provident Fund Act.

6. The Director of Public Prosecutions shall on first appointment be paid an appointment grant of $2,000.00.

8. The cost of water, gas and electricity provided to the Director of Public Prosecution's residence shall be charged to public funds and paid for by the Government.

9. The wages payable for the services of one domestic employee shall be charged to public funds and paid for by the Government.

Vehicle

10. The Director of Public Prosecutions shall be provided with a vehicle free of charge.

Leave

11. The Director of Public Prosecutions shall be entitled to leave at the rate of three and half days a month or forty-two days per annum for each year of completed service, which leave shall be taken during the year in which it accrues.

Passage

12.—(1) The Director of Public Prosecutions and his family shall be provided with air or sea passages at government expense to and from the place of domicile when proceeding on annual leave.

(2) In this regulation, 'place of domicile' includes that of the spouse.

Compassionate leave

13. The Director of Public Prosecutions shall be entitled to two return trips either by sea or air on compassionate leave per annum.

Overseas travel allowance

14.—(1) The Director of Public Prosecutions shall be entitled to a daily allowance of US$55.00 or one-fifth of the daily allowance if the travel is externally funded.

(2) Where the Director of Public Prosecutions is a guest of a host government, administration or agency and is not called upon to meet costs of accommodation and meals, he may claim subsistence allowance at the rate of one-fifth of the standard rate applicable to public officers under General Orders.

Local travel allowance

15. The Director of Public Prosecutions shall be entitled to a daily allowance of $40.00 whilst on official travel within Solomon Islands.

Class of travel (overseas visits)

16.—(1) The Director of Public Prosecutions shall be entitled to travel first class on all official visits overseas.

(2) The spouse of the Director of Public Prosecutions shall be entitled to travel first class when accompanying the Director of Public Prosecutions on any official visit overseas and shall be entitled to claim subsistence allowance at the rate payable to the Director of Public Prosecutions under regulation 14(2).

Outfit allowance

17. The Director of Public Prosecutions shall be entitled to an outfit allowance of $500 when travelling overseas. The allowance may be claimed once every three years.

Entertainment allowance

18. The Director of Public Prosecutions shall be entitled to an entertainment allowance from the Prime Minister's Office Vote for entertainment. The amount of the allowance shall be as determined by the Accounting Officer.

Medical treatment

19. The Director of Public Prosecutions shall be entitled to medical treatment in accordance with the terms prescribed from time to time for public officers.

Personal loan

20. The Director of Public Prosecutions shall be entitled to a Government-guaranteed loan, the maximum amount of which shall not exceed his annual basic salary.

Baggage allowance

21. Subject to the provisions of Chapter F of General Orders, the Director of Public Prosecutions shall be entitled to claim baggage allowance.

Death

22. Where the Director of Public Prosecutions dies whilst in office, the Government shall pay for all funeral expenses and all other expenses incidental thereto.

Miscellaneous benefits

23. The Director of Public Prosecutions shall be entitled to all other benefits available to public officers under General Orders or other regulations which are not covered by these Regulations.

Security

24. The Government shall be responsible for providing adequate security at the residence of the Director of Public Prosecutions.
