INTERNATIONAL ORGANISATIONS (IMMUNITIES AND PRIVILEGES OF CERTAIN OFFICERS) ACT

Act 10 of 1967

AN ACT TO EXTEND CERTAIN IMMUNITIES AND PRIVILEGES TO OFFICERS PROVIDED BY INTERNATIONAL ORGANISATIONS FOR SERVICES IN THE KINGDOM

Commencement [1st January, 1967]

1 Short title.

This Act may be cited as the International Organisations (Immunities and Privileges of Certain Officers) Act.

2 Definitions.

In this Act, unless the contrary intention appears-

"International Organisation" means any one or more of the following: The United Nations Organisation, The International Labour Organisation, The Food and Agricultural Organisation of the United Nations, The United Nations Educational Scientific and Cultural Organisation, The International Civil Aviation Organisation, The World Health Organisation, The International Telecommunication Union, The World Meteorological Organisation, The International Atomic Energy Agency, The Universal Postal Union and any other organisation declared by His Majesty in Council as an International Organisation for the purposes of this Act;

"Officer" means a person provided by an International Organisation to perform services for the Government pursuant to an agreement entered into between the International Organisation and the Government.

3 Certain immunities and privileges may be conferred on an Officer.

(1) Where an Officer is employed by the Government, His Majesty in Council may by Order in Council confer upon that Officer, to such extent as may be specified in the Order in Council, the immunities and privileges set out in the Schedule to this Act.

(2) An Order in Council made under this section shall be published in the Gazette and shall state the date from which the immunities and privileges take effect.

(3) Where an Officer ceases to be entitled to the immunities and privileges conferred by virtue of this Act, His Majesty in Council shall cause a notice to that effect to be published in the Gazette and the notice shall state the date on which those immunities and privileges cease to have effect.

4 Evidence.

The publication in the Gazette of an Order in Council or notice required by this Act to be published shall be conclusive proof of all matters contained in that Order in Council.

SCHEDULE

IMMUNITIES AND PRIVILEGES

1. Immunity from legal process in respect of words spoken or written and all acts performed by an officer in his official capacity.

2. Privilege of exemption from taxation on the stipends, emoluments and allowances paid to an officer by an International Organisation.
