Aquaculture Management (Amendment) Act 2009.

AN ACT TO AMEND THE AQUACULTURE MANAGEMENT ACT.

[29th October, 2009].

BE IT ENACTED by the King and Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:

1. (1) This Act may be cited as the Aquaculture Management (Amendment) Act 2009.

(2) The Aquaculture Management Act 2003 shall be referred to in this Act, as the Principal Act.

2. Section 2 of the Principal Act is amended by inserting the following new definitions in the appropriate places:

""National Biosafety Advisory Committee" means the National Biosafety Advisory Committee established under section 5 of the Biosafety Act;"; and
""living modified organism" has the same meaning as under the Biosafety Act;".

3. The Principal Act is amended by inserting the following as section 29A:

"29A Fish which are living modified organisms
No person may import, possess, sell or culture any fish which is a living modified organism in aquaculture or any related activity without the written authorisation of the Secretary and the approval of the National Biosafety Advisory Committee.".
