AN ACT TO AMEND THE BAIL ACT TO PROVIDE FOR JUSTICES OF THE PEACE AND POLICE IMPOSING BAIL CONDITIONS

BE IT ENACTED by the King and Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:

1 Short Title

This Act may be cited as the Bail (Amendment) Act 2012.

2 Section 2 amended

Section 2 of the Bail Act is amended by, in the definition of police officer, inserting at the end "and, for the purpose of granting bail, if no such police officer is available, includes a Justice of the Peace appointed under section 94A of the Magistrate's Court Act".

3 Section 5 amended

Section 5 (iii) of the Bail Act is amended by, after "Court" first appearing, inserting "or a police officer".

4 Section 6 amended

Section 6(1) of the Bail Act is amended by repealing "Court has granted bail that Court" and replacing it with "Court or a police officer has granted bail, a Court".

5 Section 7 amended

Section 7(1)(b) of the Bail Act is amended by, after "Court" first appearing, inserting "or a police officer".

6 Form 2 of the Schedule amended

The Schedule of the Bail Act is amended by, in Form 2 inserting the following paragraph before "And the accused" –

"To comply with the condition of bail appearing below.".
