BANK OF TONGA (AMENDMENT) ACT

AN ACT
TO AMEND THE BANK OF TONGA ACT

[15th of July 2002.]

BE IT ENACTED by the King and Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:-

1. (1) This Act maybe cited as the Bank of Tonga (Amendment) Act 2002.

(2) The Bank of Tonga Act (Cap 105), as amended, is in this Act referred to as the Principal Act.

2. The Principal Act is hereby amended by deleting the name "Bank of Tonga" and substituting therefor the name "Westpac Bank of Tonga" as it appears in the title, the commencement section, the body and elsewhere in the Principal Act.

3. On the coming into force of this Act, the corporate name of the body corporate constituted by the Principal Act shall be "Westpac Bank of Tonga."

4. The change of name referred to in section 3 effected by operation of that section does not operate:

(a) to create a new legal entity,

(b) to prejudice or affect the identity of the Bank of Tonga as a statutory body,

(c) to affect the property, or the rights and obligations, of the body, or

(d) to render defective any legal proceedings by or against that body;

and any legal proceedings that could have been continued or recommenced by or against the Bank in its former name may be continued or commenced by or against it in its new name.

5. On the day that this Act comes into force, a reference in an Act, other than this Act, or in any statutory instrument or other instrument, whether of the same or of a different nature, being an instrument which came into existence before this Act has come into force, to "The Bank of Tonga" or "Bank of Tonga" shall be read and construed as a reference to "Westpac Bank of Tonga".

2. 'Oku fakatonutonu heni 'a e Tefito'i Lao 'aki hono tamate'i 'a e hingoa "Pangike 'o Tonga" pea fetongi 'aki 'a e hingoa "Westpac Pangike 'o Tonga" 'i he'ene ha 'i he kupu ki he hingoa, kamata'anga, sino'i lao mo ha toe feitu'u kehe pe 'i he Tefito'i Lao.

3. 'I he taimi 'e kamata ngaue 'aki ai 'a e Lao ni, ko e hingoa fakakautaha 'o e sino fakakautaha na'e fokotu'u 'i he Tefito'i Lao kuo pau ko e "Westpac Pangike 'o Tonga".

4. Ko e liliu hingoa 'o e sino fakakautaha ko is 'oku lau ki ai 'i he Kupu 3 koe'uhi ko e ngaue 'a e Lao ni 'oku 'ikai ke ne:

(a) fa'u ha sino fakalao fo'ou;

(b) uesia 'a e hingoa mo e fa'unga 'o e Pangike 'o Tonga ke kei hokohoko atu 'ene ngaue ko ha sino fakakautaha;

(c) uesia 'a e koloa, pe ngaahi totonu mo e ngaahi ngafa, 'o e sino ko ia, pe

(d) ta'ofi ha ngaahi fakatonutonu fakalao 'oku fai faka'ilo pe faka'iloa ai 'a e sino ko ia;

pea ko ha fakatonutonu fakalao 'a is na'e mei hoko atu pe na'e mei fai faka'ilo pe faka'iloa ai 'a e sino ko is 'i hono hingoa kimu'a 'e ngofua ke hoko atu 'a e fai faka'ilo pe ko hono faka'iloa 'i hono hingoa fo'ou.

5.
