ACT OF CONSTITUTION OF TONGA (AMENDMENT) ACT 1999
No. 11 of 1999.

I assent,

AN ACT
TO AMEND THE ACT OF CONSTITUTION OF TONGA

[1st July, 1999].

BE IT ENACTED by the King and Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:

1. (1) This Act may be cited as the Act of Constitution of Tonga (Amendment) Act 1999.

(2) The Act of Constitution of Tonga (Cap. 2), as amended, is in this Act referred to as the Principal Act.

2. Clause 111 of the Principal Act is amended by inserting the following as a new paragraph at the end thereof:

"And whereas by Tongan custom the noble Niukapu forms part of the 'Ulutolu line, now therefore it is decreed that in the event the holder of the estate and title of Niukapu is not a descendant by blood of the original Niukapu before 1875, such estate and title shall revert at the death of such holder to a descendant by blood of the Niukapu line".

Passed by the Legislative Assembly this 6th day of July, 1999.

2. 'Oku fakatonutonu 'a e Kupu 111 'o e Tefito'i Lao 'aki hono fakahu ant 'eni ke hoko e palakalafi fo'ou 'i he ngata'anga 'o ia:

"Pea koe 'uhi ko e fatungamotu 'a 'o Tonga 'oku kau ai 'a e Nopele Niukapu ki he laine 'o e 'Ulutolu, ko is 'oku tu'utu'uni ai heni ka hoko 'o ma'u 'a e tofi'a tukufakaholo mo e hingoa 'o e Niukapu 'e ha taha 'oku 'ikai ko ha hako 'i he toto 'o e 'uluaki Niukapu kimu'a 'i he 1875, kuo pau ke foki 'a e tofi'a tukufakaholo mo e hingoa ko is 'i ha pekia 'a e taha 'oku ne ma'u ki ha hako 'i he toto 'o e laine Niukapu."
