DEFAMATION (AMENDMENT) ACT 1993

AN ACT
TO AMEND THE DEFAMATION ACT

[2nd November, 1993.]

BE IT ENACTED by the King and Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:

1. (1) This Act may be cited as the Defamation (Amendment) Act 1993.

(2) The Defamation Act (Cap. 33) is referred to in this Act as the Principal Act.

2. Section 3 of the Principal Act is amended by -

(i) deleting the words "the King or any member of the Royal Family" and substituted therefor the words "His Majesty the King or Her Majesty the Queen";

(ii) deleting the figure "$400" and substituted therefor the figure "$2000".

3. Section 4 of the Principal Act is repealed.

4. Section 5 of the Principal Act is amended by -

(i) deleting the words "or 4";

(ii) deleting the figure "$100" and substituted therefor the figure "$1000";

(iii) deleting the words "6 months" and substituted therefor the words "1 year".

5. Section 6 of the Principal Act is amended by deleting the figure "$50" and substituted therefor the figure "$500".

6. Section 8 of the Principal Act is amended by deleting the words "sections 3, 4, 5 or 6" and substituted therefor the words "section 3".

(2) 'Oku ui 'i he Lao ni 'a e Lao ki he Lau'ikovi (Vahe 33) ko e Tefito'i Lao.

2. 'Oku fakatonutonu 'a e Kupu 3 'o e Tefito'i Lao 'aki hono -

(i) tamate 'i 'a e ngaahi fo'i lea "e Tu 'i pe ko ha taha 'i hono famili" pea fetongi is 'aki 'a e ngaahi fo'i lea "'Ene 'Afio ko e Tu'i pe ko 'Ene 'Afio ko e Kuini";

(ii) tamate'i 'a e fika "$400" pea fetongi ia 'aki 'a e fika "$2000".

3. 'Oku fakapekia 'a e Kupu 4 'o e Tefito 'i Lao.

4. 'Oku fakatonutonu 'a e Kupu 5 'o e Tefito 'i Lao 'aki hono -

(i) tamate 'i 'a e ngaahi fo'i lea "pe kupu 4";

(ii) tamate'i 'a e fika "$100" pea fetongi ia 'aki 'a e fika "$1000";

(iii) tamate'i 'a e ngaahi fo'i lea "mahina 'e 6" pea fetongi ia 'aki 'a e ngaahi fo'i lea "ta'u 'e 1".

5. 'Oku fakatonutonu 'a e Kupu 6 'o e Tefito'i Lao 'aki hono tamate'i 'a e fika "$50" pea fetongi is 'aki 'a e fika "$500".

6. 'Oku fakatonutonu 'a e kupu 8 'o e Tefito'i Lao 'aki hono tamate'i 'a e ngaahi fo'i lea "ngaahi Kupu 3, 4, 5, pe 6" pea fetongi is 'aki 'a e ongo fo'i lea "Kupu 3".
