GOVERNMENT (AMENDMENT) ACT 2010

AN ACT TO AMEND THE GOVERNMENT ACT

24th November 2010.
BE IT ENACTED by the King and the Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:
1. Short Title
(1) This Act may be cited as the Government (Amendment) Act 2010.
(2) In this Act, the Government Act (Cap. 3), as amended, is referred to as the Principal Act.
2. Sections repealed
Sections 2, 3, 4, 5, 6, 7, 8, 10, 11, 19, 21 of the Principal Act are repealed.
3. Section 9 amended
Section 9 of the Principal Act is amended by repealing the words "passed by His Majesty in Council," and replacing them with "made by".
4. Section 17 amended
Section 17 of the Principal Act is amended -
(a) in the English version only, by repealing the words "by the King and shall hold office during the King's pleasure" and replacing them with "and hold office in accordance with clause 50A of the Constitution"; and
(b) in the Tongan version only, by repealing the words "'E fakanofo ai pe 'e he Tu'i 'a e Palemia pea te ne ma'u lakanga lolotonga 'oku finangalo ki ai 'a e Tu'i" and replacing them with "Kuo pau ko e Palemia te ne ma'u lakanga 'o fakatatau ki he kupu 50A 'o e Konisitutone".
5. Section 18 amended - Deputy Prime Minister
Section 18 of the Principal Act is amended by repealing sub-section (1) and replacing it with -
"(1) The King may, on the recommendation of the Prime Minister, appoint a Deputy Prime Minister from amongst the Cabinet Ministers.".
