INDUSTRIAL PROPERTY (AMENDMENT) ACT 1999

AN ACT
TO AMEND THE INDUSTRIAL PROPERTY ACT 1994

[1st July, 1999].

BE IT ENACTED by the King and Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:

1. (1) This Act may be cited as the Industrial Property (Amendment) Act 1999.

(2) The Industrial Property Act 1994 is in this Act referred to as the Principal Act.

2. Section 46 of the Principal Act is amended-

(1) by inserting the following new subsection as subsection (1A):

"(1A) Notwithstanding subsection (1), the Registration of United Kingdom Trade Marks Act is deemed to be in force as from 31 January 1997 until the Minister notifies in the Gazette a date for regulations under this Act to come into force."

(2) in subsection (2):

(a) by deleting the commas and words ", on the date of entry into force of this Act," in line 1;

(b) by deleting the words "entry into force of this Act" in line 5 and substituting therefor the words "the repeal of the United Kingdom Trade Marks Act".

Passed by the Legislative Assembly this 1st day of July, 1999.

2. 'Oku fakatonutonu 'a e kupu 46 'o e Tefito'i Lao-

(1) 'aki hono fakahu atu 'a e kupusi'i fo'ou ko 'eni ke kupusi'i (1A):

"(1A) Neongo 'a e kupusi'i (1), 'oku lau 'oku kamata ngaue'aki 'a e Lao ki he Lesisita 'o e Faka'ilonga ke Fakatau 'o e Pule'anga Fakatahataha 'o Pilitania mei he 'aho 31 'o Sanuali 1997 kae'oua ke fanongonongo 'e he Minisita 'i he Kasete ha 'aho 'e toki kamata ngaue'aki ai 'a e ngaahi tu'utu'uni 'i he Lao ni."

(2) 'i he kupusi'i (2):

(a) 'aki hono tamate'i 'a e ongo koma mo e ngaahi fo'i lea ", 'i he 'aho 'oku fakahoko ai 'a e Lao ni," 'i he laine 1;
