LAND (AMENDMENT) ACT

AN ACT
TO AMEND THE LAND ACT
[26th July, 1990]
BE IT ENACTED by the King and Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:
Short title
1. (1) This Act may be cited as the Land (Amendment) Act 1990.
(2) The Land Act, 1927, as amended, is in this Act referred to as the Principal Act.
Repeal and Replacement of section 140.
2. Section 140 of the Principal Act is deleted and replaced with the following:
"140. (1) Any party may, upon payment of the prescribed fee, appeal from any order or judgment of the Court-
(a) if the order or judgment relates to the determination of hereditary estates or titles, to the Privy Council pursuant to Clause 50 of the Constitution;
(b) in every other case, to the Court of Appeal.
Any such appeal shall be made in such manner as may be prescribed by rules of court within 42 days of the date of the order or judgment appealed.
(2) Sections 141 to 145 inclusive shall apply to appeals to the Privy Council."
