LAND (AMENDMENT) ACT 1993

AN ACT
TO AMEND THE LAND ACT
[27th October, 1993.]
BE IT ENACTED by the King and Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:
1. (1) This Act may be cited as the Land (Amendment) Act 1993.
(2) The Land Act (Cap. 132), as amended, is in this Act referred to as the Principal Act.
2. Section 138 of the Principal Act is amended -
(a) by renumbering that provision as subsection (1);
(b) by inserting the following as subsection (2);
"(2) The Minister shall consult the Minister of Health as to the suitability of any area of land to be declared, reserved or resumed for the purpose of creating a cemetery:
Provided that there shall also be consultation with the estate holder where the area of land to be declared, reserved or resumed by the Minister for the purpose of a cemetery is on land other than Crown Land.".
3. Subsection (2) of section 139 of the Principal Act is amended by inserting after the words "save for" the words "a body buried at sea which shall be buried in accordance with the Public Health Act 1992, or".
