METHYLATED SPIRITS (AMENDMENT) ACT 2010
Act No. 29 of 2010

AN ACT TO AMEND THE METHYLATED SPIRITS ACT

BE IT ENACTED by the King and the Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:

1 Short Title

(1) This Act may be cited as the Methylated Spirits (Amendment) Act 2010.

(2) The Methylated Spirits Act 2001 is in this Act referred to as the Principal Act.

2. Section5 (5) amended - Import licence

Section 5(5) of the Principal Act is amended by deleting "$1,000" and substituting it with "$10,000", and deleting "12 months" and substituting it with "3 years".

3 .Section 6(4) amended - Register of import of methylated spirits to be kept

Section 6(4) of the Principal Act is amended by deleting "$1,000" and substituting it with "$5,000".

4. Section 8(4) amended - Register of purchase or sales of methylated spirits to be kept

Section 8(4) of the Principal Act is amended by deleting "$1,000" and substituting it with "$5,000".

5. Section 11(1) amended - Sale to persons under 18 years prohibited

Section 11(1) of the Principal Act is amended by deleting "$1,000" and substituting it with "$10,000", and deleting "12 months" and substituting it with "3 years".

6. Section 12(2) amended - Declaration of methylated spirits on importation

Section 12(2) of the Principal Act is amended by deleting "$1,000" and substituting it with "$5,000", and deleting "12 months" and substituting it with "2 years".

7. Section 13 amended - Concealing imported methylated spirits
Section 13 of the Principal Act is amended by deleting "$1,000" and substituting it with "$5,000", and deleting "12 months" and substituting it with "2 years".

8. Section 14(1) amended - Sale of methylated spirits and beverages containing methylated spirits

Section 14(1) of the Principal Act is amended by adding the words "and shall be liable upon conviction to a fine not exceeding $10,000 or to imprisonment for a term not exceeding 3 years, or both" after the word "offence".

9. Section 17 amended - General penalty

Section 17 of the Principal Act is amended by deleting "$1,000" and substituting it with "$5,000", and deleting "12 months" and substituting it with "2 years".
