Act 13 of 1998
AN ACT TO AMEND THE PENSIONS ACT
I assent,
TAUFA'AHAU TUPOU IV,
29th October, 1998
[16th October, 1998]
BE IT ENACTED by the King and Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:
1. (1) This Act may be cited as the Pensions (Amendment) Act 1998.
(2) The Pensions Act (Cap. 8), as amended, is in this Act referred to as the Principal Act.
(3) This Act shall come into effect on 1 July 1999.
2. The Principal Act is amended by inserting the following two new sections after section 19:
"20. (1) This Act does not apply to:
(a) an officer who, at 30 June 1999,
(i) is aged less than 50 years or
(ii) has less than 15 years service; or
(b) an officer who became a holder of an established post in the Civil Service on or after 1 July 1999.
(2) The retirement benefits of a holder of an established post in the Civil Service who is aged less than 50 years or has less than 15 years service before 1 July 1999, are provided under the Retirement Fund Act 1998".
