PHARMACY (AMENDMENT) ACT 2004

AN ACT
TO AMEND THE PHARMACY ACT
[20th July, 2004.]
BE IT ENACTED by the King and the Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:
1. (1) This Act may be cited as the Pharmacy (Amendment) Act 2004.
(2) The Pharmacy Act 2001 is in this Act referred to as the Principal Act.
2. Section 2 of the Principal Act, in the English version only, is amended in the definition of the word "dispensing"' by -
(a) deleting "it" and substituting it with "is"; and
(b) inserting "authorised" after "duly".
3. Section 3(10) of the Principal Act, in the English version only, is amended by inserting "authorised" after "duly".
4. Section 4(1) of the Principal Act, in the English version only, is amended by deleting "and" where it first appears, and substituting it with "this".
5. Section 11(1)(a) of the Principal Act, in the English version only, is amended by deleting "express" and substituting it with "expressly".
6. Section 12(c) of the Principal Act, in the English version only, is amended by inserting a comma after "address" where it appears for the second time.
7. Section 13(1) of the Principal Act in the English version only, is amended by deleting "on or before the to the".
8. Section 19(4) of the Principal Act, in the English version only, is amended by deleting "statement" and substituting it with "a document".
9. Section 23(1) of the Principal Act, in the English version only, is amended by -
(a) deleting "the" after "direct" and substituting it with "that"; and
(b) deleting the sub-paragraph "(a) the subject matter or a complaint" and substituting it with "(f) the subject matter of a complaint".
10. Section 29(1)(c) of the Principal Act, in the English version only, is amended by inserting "of" before the word "pharmacy".
11. Section 30(1) of the Principal Act, in the English version only, is amended by inserting "or" after "injury".
12. Section 31 of the Principal Act, in the English version only, is amended by deleting the indentation of the final paragraph.
13. Section 35(2) of the Principal Act, in the English version only, is amended by deleting "and" where it appears for the first time and substituting it with "an".
14. Section 36(2) of the Principal Act, in the English version only, is amended by deleting "offences" and substituting it with "offence".
15. Section 38 and 39 of the Principal Act, in the English version only, are amended by deleting "licenced" wherever it appears and substituting in with "licensed".
16. Section 40(2) of the Principal Act, in the English version only, is amended by deleting "referred" and substituting it with "referred".
17. Section 43(4) of the Principal Act, in the English version only, is amended by inserting "shall" before "take".
18. Section 46(4)(b) of the Principal Act, in the English version only, is amended by inserting a comma after "information".
19. Section 47(d) of the Principal Act, in the English version only, is amended by deleting "subsection 2" and substituting it with "paragraph (b)".
