PROBATE (AMENDMENT) ACT 2010

AN ACT TO AMEND THE PROBATE ACT

I assent,
PRINCESS SALOTE PILOLEVU TUITA,
18th May 2010.

BE IT ENACTED by the King and Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:

1. (1) This Act may be cited as the Probate (Amendment) Act 2010.

(2) The Probate Act (Cap. 16) is referred to in this Act, as the Principal Act.

2. Section 38 of the Principal is amended by:

(a) re-numbering the provision as sub-section (1); and

(b) inserting the following as subsection (2):

"(2) (a) Any money received by the Court pursuant to the Retirement Fund Act 1998, or Regulations made thereunder, shall not be paid over to any beneficiary until the estate of the deceased person to which such money is related, has been adjudicated upon by the Court.

(b) The Registrar of the Court shall have power to deposit in an interest bearing account, any money received under paragraph (a).".
