SHIPPING (REGISTRATION OF VESSELS) REGULATIONS
Order 6 of 1999
Order 18 of 2004
To provide for the registration of vessels.
Every vessel other than a foreign registered vessel, operated within Vanuatu’s economic zone which is:
a fishing vessel over 8 metres in length and engaged in a commercial fishing which is not registered under a foreign flag; or
a vessel that carries passengers for hire or rewards; or
a vessel over 8 metres in length engaged in commercial trade,
must be registered pursuant to section 2.
(2) Upon signing a declaration that a vessel is a pleasure yacht and not engaged in any form of trade, the vessel may be registered as a pleasure yacht on a voluntary basis in accordance with these regulations.
2. Issuance of certificate of registration
(1) Upon receipt of a written application in the form set out in the Schedule from an owner of a vessel required to be registered
under regulation 1(1) or on a voluntary basis regulation 1(2), and upon payment of the prescribed fee, the Principal Licensing Officer
may issue a certificate of registration for the vessel provided that owner furnishes proof satisfactory to the Principal Licensing
Officer:
(a) as to ownership of the vessel;
(b) any foreign marine document for the vessel has been surrendered with the consent of the government that has issued it, or that it has legally been cancelled;
(c) the vessel is in a seaworthy condition;
the registration fee has been paid;
that the registered owner has, and continues to hold, public liability, pollution clean-up, and wreck removal insurance cover for amounts appropriate to the size of the vessel;
that all requirements contained in the Schedule have been complied with.
The form of application and the registration fee for Vanuatu flagged vessels are as prescribed in the Schedule.
3. Failure to register
(1) An owner of a vessel who fails to register or obtain a licence in accordance with these regulations commits an offence, and on
conviction is liable to a fine not exceeding VT 100,000.
(2) In addition, the owner is liable to a fine not exceeding VT 1,000 for each day or part day after the date of conviction that the offence continues.

FEES
Fees payable to the Licensing Officer, by both commercial vessels and pleasure yachts, in connection with registration and associated matters, will be determined by an order of the Minister.
