An Act to amend the Police Act [CAP 105].

Be it enacted by the President and Parliament as follows-

1 Amendment

The Police Act [CAP 105] is amended as set out in the Schedule.

2 Commencement

This Act commences on the date on which it is published in the Gazette.

AMENDMENTS OF THE POLICE ACT [CAP 105]

1 Section 81

Repeal the section.

2 After Section 82

Insert

"83 TRANSFER OF POLICE OFFICERS TO THE CORRECTIONAL SERVICES DEPARTMENT

(1) On the commencement of this Act, the Police Commissioner is to transfer to the Department of Correctional Services for a period of six months, such members of the Vanuatu Police Force, who before the commencement of this Act have been undertaking prison services, to enable the Department to administer and maintain prisons.

(2) A member of the Vanuatu Police Force who is transferred to the Department of Correctional Services under subsection (1) is:

(a) subject to the direction and control of the Director of that Department; and

(b) subject to the same terms and conditions of employment he had before the commencement of this Act.

(3) A member referred to in subsection (1), is to continue with his employment as a member of the Vanuatu Police Force, if after a period of six months with the Department, he or she is not given a permanent employment at that Department by the Public Service Commission.

84 TRANSFER OF ASSETS

The Minister may transfer any assets of the Vanuatu Police Force to the Department of Correctional Services."
