An Act to amend the Representation of the People Act No. 13 of 1982.
BE IT ENACTED by the President and Parliament as follows:
The Representation of the People Act No. 13 of 1982, as amended, hereinafter referred to as the Principal Act, is further amended by adding a new Part 8A after Part 8 as follows:
"PART 8A - SUPPLEMENTARY ELECTORAL LISTS AND ROLLS
ESTABLISHMENT OF SUPPLEMENTARY ELECTORAL LISTS AND ROLLS
16A (1) Notwithstanding anything to the contrary in the Principal Act or any other law, the Principal Electoral Officer may not later than 30 days before polling day draw up a supplementary electoral list for each polling district to include:-
- (a) any citizen who attains the age of 18 years between July 1st and polling day inclusive;
- (b) any eligible person who previously applied to be registered as a voter under the provisions of the Principal Act but who due to clerical or other error was not so registered or properly accounted for; and
- (c) any other person eligible to be registered as a voter but who did not previously apply to be or was not so registered;
provided however that any such person shall apply in person or in writing directly to the Principal Electoral Officer giving sufficient evidence of his eligibility not later than 30 days before polling day, including Saturdays and Sundays, to be so registered.
(2) The Principal Electoral Officer shall decide,
- (a) whether or not a supplementary electoral list shall be drawn up for any polling district;
- (b) whether or not an applicant is eligible to be registered;
- (c) whether or not an applicant should be included on a supplementary list;
and where he decides that an applicant is eligible to be registered on a supplementary electoral list, shall issue that person with an electoral card inthe form set out in Part 4 of Schedule 1 of the Principal Act.
(3) Having determined all applications, under subsections (1) and (2) the Principal Electoral Officer shall establish the supplementary electoral roll for each polling district for which a supplementary electoral list was drawn up not later than 21 days before polling day.
SUPPLEMENTARY ELECTORAL ROLLS TO BE PART OF ELECTORAL ROLLS
16B Subject to this Part a supplementary electoral roll shall form part of the electoral roll of a polling district and shall be endorsed and established pursuant to the Principal Act.
INDEMNITY OF OFFICERS
16C No action shall lie against the Principal Electoral Officer or other person in respect of anything done or omitted to be done by the Principal Electoral Officer or any person acting under his direction in good faith in the performance of his functions under this Part."
This Act shall come into force on the date of its assent.
