SHIPPING (AMENDMENT) ACT NO. 5 OF 2022

An Act to amend the Shipping Act [CAP 53].

Be it enacted by the President and Parliament as follows-

  1. Amendment

The Shipping Act [CAP 53] is amended as set out in the Schedule.

  1. Commencement

This Act commences on the day on which it is published in the Gazette.

SCHEDULE


AMENDMENTS OF SHIPPING ACT [CAP 53]

1 Section 1

Insert in their correct alphabetical positions:

““authorised officer” means the Commissioner and any authorised officer appointed under the Vanuatu Maritime Safety Authority Act No. 26 of 2016;
“Authority” means the Vanuatu Maritime Safety Authority established under the Vanuatu Maritime Safety Authority Act No. 26 of 2016;
“seafarer” means any person who is required by this Act to be appropriately certified under the STCW Convention as a master or a crew member of a vessel;
“vessel” means any type of craft that is used or capable of being used for the purposes of maritime transportation and includes but not limited to any fishing vessel, hovercraft, non-displacement vessel, mobile off-shore unit, but does not include seaplanes or helicopters;”

2 Section 1 (Definitions of “licensing officer”, “seaman”, “vessel” and “Vila Radio”)

Repeal the definitions.

3 References to “licensing officer” or “licensing officers”

Delete all references to “licensing officer” or “licensing officers” (wherever occurring), substitute “authorised officer” or “authorised officers”

4 References to “Principal Licensing Officer”

Delete all references to “Principal Licensing Officer” (wherever occurring), substitute “Authority”

5 References to “seaman”

Delete all references to “seaman” (wherever occurring), substitute “seafarer”

6 Section 2

Repeal the section.

7 Subsection 38(3)

Delete “Vila Radio Station”, substitute “the Authority”

8 Section 46

Repeal the section.

9 Section 47A

Repeal the section, substitute

47A. Savings - Certificates, licences, authorisations, permits and registrations
(1) Any certificate issued or licence, authorisation, permit granted or registration done by the Regulator immediately prior to the commencement of this Act, remain in force for the remainder of their term as if they were issued, granted or registered by the Authority.
(2) Any order, document or action made by the Regulator continues in force as if it were made by the Authority.”
