TELECOMMUNICATIONS, RADIOCOMMUNICATIONS AND BROADCASTING REGULATION
(AMENDMENT) ACT NO. 29 OF 2021

An Act to amend the Telecommunications, Radiocommunications and Broadcasting Regulation Act No. 30 of 2009.

Be it enacted by the President and Parliament as follows-

1. Amendment

The Telecommunications, Radiocommunications and Broadcasting Regulation Act No. 30 of 2009 is amended as set out in the Schedule.

2. Commencement

This Act commences on the day on which it is published in the Gazette.

SCHEDULE

AMENDMENTS OF TELECOMMUNICATIONS, RADIOCOMMUNICATIONS AND BROADCASTING REGULATION ACT NO. 30 OF 2009

1. Section 2

Insert in their correct alphabetical positions:

“SIM card means a Subscriber Identity Module smart card containing the telephone number of a subscriber, encoded network identification details, the personal identification number and other user data;

subscriber means a person who subscribes to the services of an electronic communications service provider either as a result of the purchase of a SIM card or a contract to provide electronic communications service by a service provider;

subscriber information means the biometric or other personal information of a subscriber recorded and stored by a service provider;

subscriber information database means the central database of a service provider, containing the specific registration information of all SIM card-based subscribers or contract-based subscribers of electronic communications services;”

2. After Paragraph 7(4)(d)

Insert,

“(da) establishing a subscriber information database to record and store subscriber information; or

(db) requiring a service provider to register subscribers in the subscriber information database; or”
